Bir hazine ta\u015f\u0131nmaz\u0131n\u0131n, \u0130darenin izni olmadan ger\u00e7ek veya t\u00fczel ki\u015filerce i\u015fgal veya tasarruf edilmesi nedeniyle ecrimisil al\u0131n\u0131r. Ecrimisilin \u00f6denmesi durumunda da tahliye engellenmez, 2886 Say\u0131l\u0131 Yasan\u0131n 75. maddesine g\u00f6re tahliye, 775 Say\u0131l\u0131 Yasan\u0131n 18. maddesine g\u00f6re de \u00fczerinde yer alan ka\u00e7ak yap\u0131lar\u0131n y\u0131k\u0131m\u0131 ilgili Kaymakaml\u0131k veya Belediye\u2019den talep edilebilir.<\/p>\n<p style=\"text-align: justify;\">Ecrimisil bedelinin belirlenebilmesi i\u00e7in, ta\u015f\u0131nmaz\u0131n de\u011ferini etkileyecek \u015feyler nelerdir durumu incelenerek hesaplan\u0131r. \u00d6rne\u011fin; izinsiz in\u015faat yapmak ve kullanmak, kiraya verilmi\u015f olan ta\u015f\u0131nmazlarda kira s\u00fcresi sona erdi\u011fi halde s\u00f6zle\u015fme yenilenmeden kullan\u0131m\u0131 s\u00fcrd\u00fcrmek, tahsisli veya kamu hizmetinde kullan\u0131lmak \u00fczere kiralanm\u0131\u015f bir binan\u0131n bir b\u00f6l\u00fcm\u00fcn\u00fc i\u015fgal etmek Ecrimisil alma hakk\u0131na sahip olunan durumlard\u0131r.<\/p>\n<p style=\"text-align: justify;\">Takdir edilmi\u015f Ecrimisler, takdir tarihinden itibaren 15(onbe\u015f) g\u00fcn i\u00e7erisinde, \u201cEcrimisil \u0130hbarnamesi\u201d ad\u0131yla d\u00fczenlenerek i\u015fgalciye tebli\u011f edilir. Vatanda\u015f\u0131n veya vekilin, \u0130hbarnamenin tebli\u011finden itibaren 30(otuz)g\u00fcn i\u00e7inde \u0130dareye dilek\u00e7e ile itiraz hakk\u0131 vard\u0131r. Bunun \u00fczerine \u0130dare, 30(otuz)g\u00fcn i\u00e7inde olumlu veya olumsuz olarak ecrimisil tutana\u011f\u0131 d\u00fczenleyerek ilgiliye tebli\u011f eder.<\/p>\n<p style=\"text-align: justify;\">Bu tebligattan itibaren 60 (altm\u0131\u015f) g\u00fcn i\u00e7inde \u0130dari yarg\u0131da ecrimisil d\u00fczeltme ihbarnamesinin iptali i\u00e7in dava a\u00e7\u0131labilir. Kar\u015f\u0131 dava a\u00e7\u0131lsa bile, Ecrimisil tutar\u0131 tahsis edilmek zorundad\u0131r. Hazine Ta\u015f\u0131nmazlar\u0131nda Ecrimisil \u0130\u015flemleri<\/strong><\/p>\n<p>Hazine ta\u015f\u0131nmazlar\u0131n\u0131n ger\u00e7ek veya t\u00fczel ki\u015filerce i\u015fgale u\u011frad\u0131\u011f\u0131n\u0131n tespit edilmesi h\u00e2linde; tespit tarihinden itibaren onbe\u015f g\u00fcn i\u00e7inde ta\u015f\u0131nmaz tespit tutana\u011f\u0131na dayan\u0131larak bedel tespit komisyonunca tespit tarihinden geriye do\u011fru be\u015f y\u0131l\u0131 ge\u00e7memek \u00fczere, bedel tespit komisyonunca ecrimisil tespit ve takdir edilir.<\/p>\n<p>Ecrimisil tespit ve takdir edilirken, Hazine ta\u015f\u0131nmaz\u0131n\u0131n de\u011ferini etkileyebilecek; imar durumu, y\u00fcz\u00f6l\u00e7\u00fcm\u00fc, niteli\u011fi, verimi (tar\u0131m arazilerinde), alt yap\u0131 hizmetlerinden yararlan\u0131p yararlanmad\u0131\u011f\u0131, konumu, ta\u015f\u0131nmaz\u0131n kullan\u0131m \u015fekli ve i\u015fgalden dolay\u0131 gelir elde edilip edilmedi\u011fi gibi her t\u00fcrl\u00fc \u00f6l\u00e7\u00fctler dikkate al\u0131n\u0131r.<\/p>\n<p>Ecrimisilin tespitinde ayr\u0131ca; ayn\u0131 yer ve mahalde bulunan emsal nitelikteki ta\u015f\u0131nmazlar i\u00e7in olu\u015fmu\u015f kira bedelleri veya ecrimisiller, varsa bunlara ili\u015fkin kesinle\u015fmi\u015f yarg\u0131 kararlar\u0131, ilgisine g\u00f6re belediye, ticaret odas\u0131, sanayi odas\u0131, ziraat odas\u0131, borsa gibi kurulu\u015flardan veya bilirki\u015filerden soru\u015fturulmak suretiyle edinilecek bilgiler ile ta\u015f\u0131nmaz\u0131n de\u011ferini etkileyecek t\u00fcm unsurlar g\u00f6z \u00f6n\u00fcnde bulundurulur. Ecrimisil tespit ve takdirinde g\u00f6z \u00f6n\u00fcnde bulundurulacak bilgiler, gerekti\u011finde k\u00f6y, mahalle, cadde ve sokak itibariyle sorulabilir.<\/p>\n<p>Ecrimisil bedeli; bedel tespit komisyonunca tar\u0131msal ama\u00e7l\u0131 kullan\u0131mlar ile belediye ve m\u00fccavir alan s\u0131n\u0131rlar\u0131 d\u0131\u015f\u0131nda gelir getirici unsur ta\u015f\u0131mayan kullan\u0131mlar i\u00e7in ta\u015f\u0131nmaz\u0131n emlak vergisine esas asgari de\u011ferinin y\u00fczde birbu\u00e7u\u011fundan; belediye ve m\u00fccavir alan s\u0131n\u0131rlar\u0131 i\u00e7inde ve planl\u0131 alanlarda tar\u0131m d\u0131\u015f\u0131 kullan\u0131mlar i\u00e7in ise ta\u015f\u0131nmaz\u0131n emlak vergisine esas asgari de\u011ferinin y\u00fczde \u00fc\u00e7\u00fcnden az olmamak \u00fczere ecrimisil tespit ve takdir edilir.<\/p>\n<p>Belediye ve m\u00fccavir alan s\u0131n\u0131rlar\u0131 d\u0131\u015f\u0131nda veya k\u00f6y s\u0131n\u0131rlar\u0131 i\u00e7inde olan ve tar\u0131msal ama\u00e7la kullan\u0131lmakta iken, belediye s\u0131n\u0131rlar\u0131n\u0131n geni\u015flemesi sonucunda belediye ve m\u00fccavir alan s\u0131n\u0131rlar\u0131 i\u00e7inde kalan ve\/veya imar plan\u0131na tabi tutulan ta\u015f\u0131nmazlar\u0131n tar\u0131msal ama\u00e7l\u0131 kullan\u0131m\u0131ndan dolay\u0131 ecrimisil tespit ve takdirinde, tar\u0131msal kullan\u0131m dikkate al\u0131n\u0131r. Ancak, bu ta\u015f\u0131nmazlar\u0131n ecrimisil bedeli; ta\u015f\u0131nmaz\u0131n s\u0131n\u0131rlar\u0131 i\u00e7erisinde bulundu\u011fu il\u00e7ede taban, k\u0131ra\u00e7 ve sulu arazi i\u00e7in belirlenen emlak vergisine esas asgari arazi metrekare birim bedellerinin y\u00fczde bir bu\u00e7u\u011fundan az olamaz.<\/p>\n<p>Emlak vergisine esas asgari metrekare birim de\u011feri belirlenmemi\u015f olan Devletin h\u00fck\u00fcm ve tasarrufu alt\u0131nda olan yerler i\u00e7in ecrimisil tespit ve takdirinde, birim de\u011feri belirlenen en yak\u0131n emsal ta\u015f\u0131nmaz\u0131n emlak vergisine esas metre kare birim de\u011feri dikkate al\u0131n\u0131r.<\/p>\n<p><strong>Ancak, tespit ve takdir edilen ecrimisil bedeli kira bedelinden az olamaz.<\/strong><\/p>\n<p>Takdir edilen ecrimisiller, takdir tarihinden itibaren onbe\u015f g\u00fcn i\u00e7inde ecrimisil ihbarnamesi d\u00fczenlenerek fuzuli \u015fagile, 11\/2\/1959 tarihli ve 7201 say\u0131l\u0131 Tebligat Kanunu h\u00fck\u00fcmlerine g\u00f6re \u00f6ncelikle elden veya iadeli taahh\u00fctl\u00fc mektupla, bu \u015fekilde tebli\u011f edilemeyenler di\u011fer usullere g\u00f6re tebli\u011f edilir. Ecrimisil i\u015fleminde \u0130darece maddi, ki\u015fide, i\u015fgal edilen alanda veya y\u00fcz\u00f6l\u00e7\u00fcmde ya da benzer \u015fekilde hata oldu\u011funun belirlenmesi halinde, bu hata \u0130darece hangi a\u015famada olursa olsun resen d\u00fczeltilir ve yeniden ecrimisil ihbarnamesi d\u00fczenlenerek ilgililerine tebli\u011f edilir.<\/p>\n<p>Ecrimisil i\u015flemine kar\u015f\u0131, tebli\u011f tarihinden itibaren otuz g\u00fcn i\u00e7inde ilgili \u0130dareye dilek\u00e7eyle m\u00fcracaat edilerek d\u00fczeltme talebinde bulunulabilir. Bu s\u00fcre i\u00e7erisinde ecrimisil i\u015flemine kar\u015f\u0131 d\u00fczeltme talebinde bulunulmak suretiyle itiraz edilmemesi veya itiraz edilmesine ra\u011fmen ayn\u0131 s\u00fcre i\u00e7erisinde bu itirazdan kay\u0131ts\u0131z ve \u015farts\u0131z olarak vazge\u00e7ilmesi ya da yine bu s\u00fcre i\u00e7erisinde dava a\u00e7\u0131lm\u0131\u015f ise ayn\u0131 s\u00fcre i\u00e7erisinde davadan kay\u0131ts\u0131z ve \u015farts\u0131z olarak feragat edilmesi halinde y\u00fczde yirmi indirim uygulan\u0131r.<\/p>\n<p>D\u00fczeltme talepleri, talep tarihinden itibaren en ge\u00e7 otuz g\u00fcn i\u00e7inde bu ama\u00e7la olu\u015fturulacak komisyonlarca karara ba\u011flan\u0131r ve sonucu karar tarihinden itibaren en ge\u00e7 onbe\u015f g\u00fcn i\u00e7inde d\u00fczenlenecek Ecrimisil D\u00fczeltme \u0130hbarnamesi ile ilgilisine tebli\u011f edilir. Ecrimisil ihbarnamesine yap\u0131lan itiraz veya a\u00e7\u0131lan dava ile ecrimisil d\u00fczeltme ihbarnamesine a\u00e7\u0131lan dava \u0130darece yap\u0131lan ve resen d\u00fczeltilmesi gereken hatalara ili\u015fkin ve bu hata \u0130darece d\u00fczeltilir ise; bu durumda da a\u00e7\u0131lan davadan kay\u0131ts\u0131z ve \u015farts\u0131z olarak feragat edilmesi halinde y\u00fczde yirmi indirim uygulan\u0131r.<\/p>\n<p>D\u00fczeltme taleplerini inceleyip karara ba\u011flayacak komisyonlar\u0131n kurulu\u015fu, \u00e7al\u0131\u015fma esaslar\u0131 ve yetki s\u0131n\u0131rlar\u0131na ili\u015fkin usul ve esaslar Bakanl\u0131k\u00e7a belirlenir.<\/p>\n<p><strong><span style=\"color: #ff0000;\">Ecrimisil<\/span><\/strong>; Ecrimisil \u0130hbarnamesinin, d\u00fczeltme talebinde bulunulmu\u015f ise Ecrimisil D\u00fczeltme \u0130hbarnamesinin ilgilisine tebli\u011f tarihinden itibaren altm\u0131\u015f g\u00fcn i\u00e7inde muhasebe birimlerine \u00f6denir. Bu s\u00fcre i\u00e7erisinde ecrimisilin pe\u015fin \u00f6denmesi halinde y\u00fczde onbe\u015f indirim uygulan\u0131r. Ecrimisil bor\u00e7lusunun \u00f6deme g\u00fc\u00e7l\u00fc\u011f\u00fc nedeniyle yaz\u0131l\u0131 olarak talep etmesi h\u00e2linde ecrimisil, en az y\u00fczde yirmibe\u015fi pe\u015fin kalan k\u0131sm\u0131 ise \u0130darenin uygun g\u00f6rece\u011fi taksit zamanlar\u0131nda ve en fazla \u00fc\u00e7 y\u0131l i\u00e7inde taksitler h\u00e2linde \u00f6denebilir. Alaca\u011f\u0131n kalan k\u0131sm\u0131na kanun\u00ee faiz uygulan\u0131r.<\/p>\n<p>K\u00f6y s\u0131n\u0131rlar\u0131 i\u00e7erisinde yer alan Hazinenin \u00f6zel m\u00fclkiyetinde veya Devletin h\u00fck\u00fcm ve tasarrufu alt\u0131nda bulunan ta\u015f\u0131nmazlar\u0131n i\u015fgalcilerinden tahsil edilen ecrimisil gelirlerinin y\u00fczde be\u015fi, 442 say\u0131l\u0131 K\u00f6y Kanununda belirlenen g\u00f6revlerde kullan\u0131lmak kayd\u0131yla, tahsilat\u0131 izleyen ay i\u00e7inde bu gelirlerin elde edildi\u011fi k\u00f6y t\u00fczel ki\u015fili\u011fi hesab\u0131na aktar\u0131lmak \u00fczere muhasebe birimince emanet nitelikli hesaplara kaydedilir. Bakanl\u0131k taraf\u0131ndan bu oran iki kat\u0131na kadar artt\u0131r\u0131labilir.<\/p>\n<p>Ecrimisil \u0130hbarnamesinin, d\u00fczeltme talebinde bulunulmu\u015f ise Ecrimisil D\u00fczeltme \u0130hbarnamesinin ilgilisine tebli\u011f tarihinden itibaren altm\u0131\u015f g\u00fcn i\u00e7inde muhasebe birimlerine r\u0131zaen \u00f6denmeyen ecrimisil; d\u00fczeltme talebinde bulunulmam\u0131\u015f ise y\u00fczde yirmi indirim yap\u0131lmak suretiyle milli emlak birimlerince, dava a\u00e7ma s\u00fcreleri ge\u00e7tikten sonra 6183 say\u0131l\u0131 Amme Alacaklar\u0131n\u0131n Tahsil Usul\u00fc Hakk\u0131nda Kanun h\u00fck\u00fcmlerine g\u00f6re takip ve tahsil edilmek \u00fczere vergi dairelerine veya gelir servislerine intikal ettirilir. Vergi daireleri veya gelir servisleri, kendilerine intikal ettirilen ecrimisil alacaklar\u0131n\u0131 an\u0131lan Kanunun kapsam\u0131na giren amme alacaklar\u0131 gibi takip ve tahsil ederek sonu\u00e7lar\u0131n\u0131 mill\u00ee emlak birimlerine bildirirler.<\/p>\n<p>Ecrimisil taksitlerinden birinin vadesinde \u00f6denmemesi durumunda, kalan ecrimisil alaca\u011f\u0131n\u0131n tamam\u0131 muaccel h\u00e2le gelir ve Ecrimisil \u0130hbarnamesinin muhatab\u0131na tebli\u011f tarihini takip eden altm\u0131\u015f\u0131nc\u0131 g\u00fcn\u00fcn bitiminden itibaren gecikme zamm\u0131 uygulanmak suretiyle tahsil edilmek \u00fczere vergi dairelerine veya gelir servislerine intikal ettirilir.<\/p>\n<p>Fuzuli \u015fagiller taraf\u0131ndan dava a\u00e7\u0131lm\u0131\u015f olmas\u0131, ecrimisilin takip ve tahsil edilmesi i\u015flemini durdurmaz.<\/p>\n<p>Fuzuli \u015fagilin i\u015fgal veya tasarruf etti\u011fi ta\u015f\u0131nmazdan tahliyesinin herhangi bir nedenle sa\u011flanamam\u0131\u015f olmas\u0131, ayn\u0131 ta\u015f\u0131nmazdan ikinci ve m\u00fcteakip defa ecrimisil istenmesine engel te\u015fkil etmez. Ecrimisilin tahsil edilmesi, ta\u015f\u0131nmazdaki kullan\u0131m\u0131n devam\u0131 hakk\u0131n\u0131 vermez.<\/p>\n<p><span class=\"ms-rteFontSize-3\"><strong>\u200b4.<\/strong><strong>Hazine Ta\u015f\u0131nmazlar\u0131nda Tahliye \u0130\u015flemleri<\/strong><\/span><\/p>\n<p>Kiraya verilen, irtifak hakk\u0131 kurulan veya kullanma izni verilen ta\u015f\u0131nmazlardan s\u00fcresi doldu\u011fu h\u00e2lde tahliye edilmeyen, s\u00f6zle\u015fmesi feshedilen veya herhangi bir s\u00f6zle\u015fmeye dayanmaks\u0131z\u0131n fuzuli olarak i\u015fgal edilen Hazine ta\u015f\u0131nmazlar\u0131n\u0131n tahliyesi; hasat sezonu, i\u015f ve hizmetlerin mevsimlik faaliyet d\u00f6nemi de dikkate al\u0131narak defterdarl\u0131k veya malm\u00fcd\u00fcrl\u00fc\u011f\u00fcn\u00fcn talebi \u00fczerine, bulundu\u011fu yer m\u00fclki amirince en ge\u00e7 onbe\u015f g\u00fcn i\u00e7inde sa\u011flanarak, ta\u015f\u0131nmaz \u0130darece g\u00f6revlendirilecek memurlara bo\u015f olarak teslim edilir.<\/p>\n<p>\u00dczerinde sabit tesis bulunan ta\u015f\u0131nmazlar\u0131n tahliyesinden ve teslim al\u0131nmas\u0131ndan sonra, eski kirac\u0131s\u0131 veya fuzuli \u015fagiline bu tesisler kendilerine ait ise y\u0131kt\u0131r\u0131l\u0131p enkaz\u0131n\u0131n en ge\u00e7 otuz g\u00fcn i\u00e7inde g\u00f6t\u00fcr\u00fclmesi, aksi h\u00e2lde masraflar\u0131 kendisinden tahsil edilmek \u00fczere y\u0131k\u0131m ve enkaz g\u00f6t\u00fcrme i\u015finin \u0130darece yap\u0131laca\u011f\u0131 tebli\u011f olunur. Verilen bu s\u00fcre sonunda tesis y\u0131kt\u0131r\u0131l\u0131p enkaz g\u00f6t\u00fcr\u00fclmedi\u011fi takdirde masraflar\u0131 bilahare eski kirac\u0131 veya fuzuli \u015fagilden al\u0131nmak \u00fczere bu i\u015flem \u0130darece yap\u0131l\u0131r.<\/p>\n<p>Men&#8217;i m\u00fcdahale ve kal ile ilgili yarg\u0131 kararlar\u0131n\u0131n icra dairelerince, vali veya kaymakam taraf\u0131ndan verilen tecav\u00fcz\u00fcn \u00f6nlenmesi ile ilgili kararlar\u0131n infaz memurlar\u0131nca uygulanmas\u0131 s\u0131ras\u0131nda gerekli olan ara\u00e7, gere\u00e7 ve personel kamu idarelerinden sa\u011flan\u0131r. Bunun m\u00fcmk\u00fcn olmamas\u0131 durumunda y\u0131k\u0131m i\u015flemi, 4\/1\/2002 tarihli ve 4734 say\u0131l\u0131 Kamu \u0130hale Kanununa g\u00f6re ihale edilir.<\/p>\n<p><strong class=\"ms-rteFontSize-3\">\u200b5. \u00d6zellik Arzeden Ecrimisil \u0130\u015flemleri<\/strong><\/p>\n<p><strong>\u00a0 \u00a0 \u00a01. Ancak, bu yerlerden evveliyat\u0131 itibar\u0131yla tapuda ki\u015filer ad\u0131na kay\u0131tl\u0131 olan ta\u015f\u0131nmazlar hakk\u0131nda, bu yerlerin tapular\u0131n\u0131n iptali ile Hazine ad\u0131na tesciline ili\u015fkin mahkeme kararlar\u0131n\u0131n kesinle\u015fti\u011fi tarihten itibaren (bu kararlar\u0131n tapuda infaz edilerek bu ta\u015f\u0131nmazlar\u0131n tapuda Hazine ad\u0131na tescil edilip edilmedi\u011fine bak\u0131lmaks\u0131z\u0131n) ecrimisil tespit, takdir ve tahsilat\u0131 yap\u0131l\u0131r.<\/p>\n<p>&#8211; 6831 say\u0131l\u0131 Orman Kanununun 2 nci maddesinin son f\u0131kras\u0131 gere\u011fince ve bu f\u0131krada belirtilen s\u00fcre i\u00e7in, 17\/10\/1983 tarihli ve 2924 say\u0131l\u0131 Orman K\u00f6yl\u00fclerinin Kalk\u0131nmalar\u0131n\u0131n Desteklenmesi Hakk\u0131nda Kanun h\u00fck\u00fcmleri gere\u011fince hak sahipli\u011fi tespiti yap\u0131lan yerleri kullananlardan ecrimisil al\u0131nmaz.<\/p>\n<p>&#8211; 6292 say\u0131l\u0131 Kanun h\u00fck\u00fcmlerine g\u00f6re hak sahiplerine do\u011frudan sat\u0131lan, tapu kay\u0131tlar\u0131 ge\u00e7erli kabul edilerek devredilen ve iade edilen ta\u015f\u0131nmazlar\u0131n tapu k\u00fct\u00fcklerindeki 6831 say\u0131l\u0131 Kanunun 2 nci ve 2\/B maddesine tabi oldu\u011fu y\u00f6n\u00fcnde konulmu\u015f belirtmeler, Maliye Bakanl\u0131\u011f\u0131n\u0131n talebi \u00fczerine tapu idaresince terkin edilir. Sa\u011flanan korumadan miras\u00e7\u0131lar\u0131n hepsi yararlan\u0131r\u201d&#8221; ( Ko\u015fut anlamda TMK. mad. 702\/IV )<\/p>\n<p>TMK. mad. 640\/IV h\u00fckm\u00fc, miras\u00e7\u0131lardan biri ya da bir k\u0131sm\u0131n\u0131n ba\u015fvurabilece\u011f i yasal yollar\u0131 \u201c\u201dterekedeki haklar\u0131n korunmas\u0131\u201d&#8221; ile s\u0131n\u0131rl\u0131 tutmu\u015ftur. A\u00e7\u0131lan dava veya ba\u015fvurulan yasal yolun bu nitelikte olmad\u0131\u011f\u0131 durumlarda ana kural ( TMK. mad. 702\/II ) ge\u00e7erli olup, bir ya da bir k\u0131s\u0131m miras\u00e7\u0131n\u0131n istemi, s\u0131fat yoklu\u011fundan reddedilecektir.<\/p>\n<p>Uyu\u015fmazl\u0131k konusu olayda, davac\u0131, murisinden intikal eden ta\u015f\u0131nmaza ( payda\u015f bulunmayan ) daval\u0131n\u0131n elatmas\u0131n\u0131n \u00f6nlenmesi ile birlikte ecrimisil istemi\u015ftir. Terekeye dahil bir ta\u015f\u0131nmaza elatman\u0131n \u00f6nlenmesi davas\u0131 \u201c\u201dterekedeki haklar\u0131n korunmas\u0131\u201d&#8221; kavram\u0131na dahil oldu\u011fundan miras\u00e7\u0131lardan herhangi birisi veya birka\u00e7\u0131 taraf\u0131ndan a\u00e7\u0131labilir. Buna kar\u015f\u0131n ecrimisil davas\u0131, \u201c\u201dterekedeki haklar\u0131n korunmas\u0131\u201d&#8221; ile ilgili olmay\u0131p terekedeki ta\u015f\u0131nmazdan yararlanmaya y\u00f6nelik bulunmaktad\u0131r. B\u00f6yle bir durumda ana kural gere\u011fince birlikte hareket etme gere\u011fi vard\u0131r. Bu nedenle, i\u015ftirak halinde m\u00fclkiyet konusu olan bir mal veya hakka ili\u015fkin ( \u00f6rne\u011fin uyu\u015fmazl\u0131k konusu olan olayda oldu\u011fu \u00fczere &#8211; ecrimisil &#8211; ) davalar\u0131n\u0131n, -ba\u011f\u0131ms\u0131z olarak a\u00e7\u0131ld\u0131\u011f\u0131 takdirde elbirli\u011fi ( i\u015ftirak ) halindeki maliklerin ( payda\u015flar\u0131n ) hepsi taraf\u0131ndan veya hepsine kar\u015f\u0131 birlikte a\u00e7\u0131lmas\u0131 zorunludur.<\/p>\n<p>II\/1 ) TEREKEDEN ( veya tereke mallar\u0131n\u0131n semerelerinden ) FAYDALANMA B\u0130RL\u0130KTE HAREKET ESASINA DAYANIR.<\/p>\n<p>Miras\u00e7\u0131lar, tereke mallar\u0131n\u0131 kullanabilir ve bunlardan yararlanabilirler. Kullanma ve istifade hakk\u0131 m\u00fc\u015fterektir ve t\u00fcm miras\u00e7\u0131lara aittir. Bu hak, terekenin idaresine ve birlikte hareket esas\u0131na dayan\u0131r. Bu konuda, miras\u00e7\u0131lar\u0131n anla\u015fmalar\u0131 \u015fartt\u0131r. Nitekim \u0130svi\u00e7re Federal Mahkemesi de dava yoluyla bir alaca\u011f\u0131 takipte, tasarruf mahiyeti g\u00f6rm\u00fc\u015ft\u00fcr. Giritlio\u011flu, Necla: M\u00fcdahalenin Men\u2019i ( elatman\u0131n \u00f6nlenmesi ) Davas\u0131, \u0130st. 1984, sh. 55 ve orada an\u0131lan FEHR ).<\/p>\n<p>IV- OBJEKT\u0130F DAVA B\u0130RLE\u015eMES\u0130<\/p>\n<p>Bu halde davac\u0131, daval\u0131ya kar\u015f\u0131 olan birden fazla talebini ( elatman\u0131n \u00f6nlenmesi + ecrimisil ) ayn\u0131 davada birle\u015ftirir; yani birden fazla davas\u0131n\u0131 ( ayn\u0131 daval\u0131ya kar\u015f\u0131 ) ayn\u0131 dava dilek\u00e7esi ile a\u00e7ar, buna objektif dava birle\u015fmesi denir. Davalar\u0131n birle\u015fmesi taleplerin maddi hukuk bak\u0131m\u0131ndan hukuksal niteli\u011fini de\u011fi\u015ftirmedi\u011fi gibi kendilerine usul hukuku y\u00f6n\u00fcnden de bir ayr\u0131cal\u0131k sa\u011flamaz. Bir ba\u015fka anlat\u0131mla, talepler ayr\u0131 ayr\u0131 ba\u011f\u0131ms\u0131zd\u0131r, kendilerine \u00f6zg\u00fc hukuk kurallar\u0131na ba\u011fl\u0131d\u0131r ve bu nedenle de ecrimisil istemi ba\u015fka bir talebin ( elatman\u0131n \u00f6nlenmesi ) yukar\u0131da a\u00e7\u0131klanan hukuksal ayr\u0131cal\u0131\u011f\u0131ndan yararlanamaz.<\/p>\n<p>V- TAPU KAPSAM VE SINIRI Y\u00d6N\u00dcNDEN GEREKL\u0130 \u00d6ZEN G\u00d6STER\u0130LMEL\u0130D\u0130R.<\/p>\n<p>Bundan ayr\u0131, tapu sicili aleni olup tapu kay\u0131tlar\u0131 iptal edilinceye kadar ge\u00e7erlili\u011fini korur. Daval\u0131n\u0131n, tapu kayd\u0131na g\u00f6re gerekli \u00f6zeni g\u00f6stererek ta\u015f\u0131nmaz\u0131n\u0131 kullanmas\u0131 gerekirdi. Zira tapusunun s\u0131n\u0131r\u0131 ve kapsam\u0131 y\u00f6n\u00fcnden kendisinden beklenen \u00f6zeni g\u00f6stermeyen kimse, TMK. 993-995 anlam\u0131nda iyiniyetli say\u0131lamaz.<\/p>\n<p>VI-SONU\u00c7 :<\/p>\n<p>Bir davada taraflar\u0131n taraf ehliyetine sahip olmalar\u0131 dava \u015fartlar\u0131ndand\u0131r. Bu nedenle, davan\u0131n taraflar\u0131ndan birinin taraf ehliyetine sahip olmad\u0131\u011f\u0131 mahkemece kendili\u011finden ( re\u2019sen ) g\u00f6zetilir ve dava esasa girilmeden ( mesmu olmad\u0131\u011f\u0131ndan ) reddedilir.<\/p>\n<p>Elbirli\u011fi ( i\u015ftirak ) halindeki m\u00fclkiyet kurallar\u0131 ( TMK. mad. 640, 702 ) gere\u011fince, miras ortakl\u0131\u011f\u0131n\u0131n ( terekenin ) t\u00fcm\u00fcne ili\u015fkin davalar\u0131n, b\u00fct\u00fcn miras\u00e7\u0131lar taraf\u0131ndan birlikte a\u00e7\u0131lmas\u0131 gerekir ( zorunlu dava arkada\u015fl\u0131\u011f\u0131 ).<\/p>\n<p>Davac\u0131 miras\u00e7\u0131n\u0131n kendi a\u00e7t\u0131\u011f\u0131 b\u00f6yle bir davay\u0131 yaln\u0131z ba\u015f\u0131na y\u00fcr\u00fctemez Davay\u0131 t\u00fcm miras\u00e7\u0131lar\u0131n birlikte y\u00fcr\u00fctmeleri gerekir. \u015eu var ki, mahkeme davac\u0131n\u0131n a\u00e7t\u0131\u011f\u0131 davay\u0131 hemen reddetmemelidir. Mahkemece, di\u011fer miras\u00e7\u0131lar\u0131n davaya kat\u0131lmas\u0131 ( icazet vermelerini ) sa\u011flamas\u0131 veya terekeye temsilci tayin ettirmesi ( TMK. mad. 640 ) i\u00e7in davac\u0131ya uygun bir s\u00fcre vermelidir ( Kar\u015f. 11.10.1982 g\u00fcn ve 3\/2 say\u0131l\u0131 \u00c7it. Bir. Kar. ).<\/p>\n<p>O halde mahkemece yap\u0131lacak i\u015f; yukar\u0131da a\u00e7\u0131klanan ilkeler do\u011frultusunda ara\u015ft\u0131rma ve inceleme yap\u0131larak var\u0131lacak uygun sonu\u00e7 dairesinde bir karar vermekten ibarettir.<\/p>\n<p>Bu itibarla yukar\u0131da a\u00e7\u0131klanan esaslar g\u00f6z\u00f6n\u00fcnde tutulmaks\u0131z\u0131n yaz\u0131l\u0131 \u015fekilde h\u00fck\u00fcm tesisi isabetsiz, temyiz itirazlar\u0131 bu nedenlerle yerinde oldu\u011fundan kabul\u00fc ile h\u00fckm\u00fcn HUMK.nun 428. maddesi gere\u011fince ( BOZULMASINA ), ve pe\u015fin al\u0131nan temyiz harc\u0131n\u0131n istek halinde temyiz edene iadesine, 6.11.2003 tarihinde oybirli\u011fiyle karar verildi.<\/p>\n<div><b><i>Iyiniyetli olmayan zilyet, geri vermekle y\u00fck\u00fcml\u00fc oldu\u011fu \u015feyi haks\u0131z al\u0131koymu\u015f olmas\u0131 y\u00fcz\u00fcnden hak sahibine vermi\u015f oldu\u011fu zararlar ve elde etti\u011fi veya elde etmeyi ihmal eyledi\u011fi \u00fcr\u00fcnler kar\u015f\u0131l\u0131\u011f\u0131nda tazminat \u00f6demek zorundad\u0131r.<\/i><\/b><\/div>\n<div><\/div>\n<div><b><i>\u0130yi niyetli olmayan zilyet, yapt\u0131\u011f\u0131 giderlerden ancak hak sahibi i\u00e7in de zorunlu olanlar\u0131n tazmin edilmesini isteyebilir.<\/i><\/b><\/div>\n<div><b><i>\u0130yi niyetli olmayan zilyet, \u015feyi kime geri verece\u011fini bilmedi\u011fi s\u00fcrece ancak kusuruyla verdi\u011fi zararlardan sorumlu olur (TMK. md. 995).<\/i><\/b><\/div>\n<div><b>\u00a0<\/b><\/div>\n<div><b><i>\u0130\u015f, i\u015fi g\u00f6r\u00fclenin yarar\u0131 i\u00e7in yap\u0131lmam\u0131\u015f olsa bile, o, i\u015ften do\u011fan yararlar\u0131 kendisine maletme hakk\u0131na sahiptir.<\/i><\/b><\/div>\n<div><b><i>\u0130\u015fi g\u00f6r\u00fclen, kendisine maletti\u011fi yararlar oran\u0131nda, i\u015fg\u00f6renin giderlerini \u00f6demekle ve onu, girmi\u015f oldu\u011fu bor\u00e7lardan kurtarmakla y\u00fck\u00fcml\u00fcd\u00fcr (BK. md. 414).<\/i><\/b><\/div>\n<div><b>\u00a0<\/b><\/div>\n<div><b>I. Kavram<\/b><\/div>\n<div>Bir ecrimisil davas\u0131ndan s\u00f6z edebilmek i\u00e7in, daval\u0131n\u0131n, haks\u0131z ve k\u00f6t\u00fc niyetli olarak, davac\u0131n\u0131n izni olmadan, onun ta\u015f\u0131nmaz\u0131na elat\u0131p kullanmas\u0131 gerekir.<\/div>\n<div>Bir kimsenin \u00fczerinde hi\u00e7 bir hakk\u0131 bulunmad\u0131\u011f\u0131n\u0131 bildi\u011fi veya bilebilecek durumda oldu\u011fu bir ta\u015f\u0131nmaz\u0131 kiraya verip kiralar\u0131n\u0131 alm\u0131\u015f olmas\u0131 durumu, k\u00f6t\u00fc niyetli zilyedin eli alt\u0131ndaki mal\u0131n medeni semerelerini alm\u0131\u015f olmas\u0131 durumudur.<\/div>\n<div>Davac\u0131 ta\u015f\u0131nmazla m\u00fclkiyet veya zilyetlik ba\u011f\u0131n\u0131; daval\u0131 ise kullanmas\u0131n\u0131n k\u00f6t\u00fc niyete veya haks\u0131z bir nedene dayanmad\u0131\u011f\u0131n\u0131, tam tersine ta\u015f\u0131nmazla ve kullan\u0131mla hakl\u0131 bir ilgisinin bulundu\u011funu kan\u0131tlamal\u0131d\u0131r.<\/div>\n<div>Haks\u0131z kullanma tazminat\u0131, \u201chaks\u0131z i\u015fgal tazminat\u0131\u201d olup, k\u00f6t\u00fc niyetli zilyetten istenir. \u201cK\u00f6t\u00fc niyetli i\u015fgal\u201d olgusu bu t\u00fcr davalar\u0131n \u00f6z\u00fcn\u00fc olu\u015fturur. Bu nedenle tazminat isteyen davac\u0131n\u0131n malik olmas\u0131 yeterli olmay\u0131p, \u201c\u015fagil\u201din ayr\u0131ca k\u00f6t\u00fc niyetli olmas\u0131 gerekir.<\/div>\n<div><b>II. Kapsam<\/b><\/div>\n<div><b>A. Ka\u00e7ak Yap\u0131larda Ecrimisil<\/b><\/div>\n<div>\u0130mar Kanunu h\u00fck\u00fcmleri uyar\u0131nca in\u015faat yap\u0131m i\u015fleri ilgili merciinden al\u0131nacak ruhsata ba\u011fl\u0131d\u0131r. Yap\u0131lacak in\u015faat\u0131n onayl\u0131 ruhsat ve eklerine uygun olmas\u0131 gerekir. Yap\u0131 eylemli olarak onayl\u0131 projeye ayk\u0131r\u0131 in\u015fa edilmi\u015fse, projesine ayk\u0131r\u0131 olan bu yerler kamu d\u00fczeninden olan imar mevzuat\u0131 kar\u015f\u0131s\u0131nda ka\u00e7ak in\u015faat say\u0131laca\u011f\u0131ndan buralar i\u00e7in ecrimisil istenemez. Ekonomik de\u011feri bulunmayan bu yerlerin sadece y\u0131k\u0131\u00adm\u0131 istenebilir.<\/div>\n<div><b>B.S\u00f6zle\u015fmenin Geriye Etkili Bozulmas\u0131 Durumunda Ecrimsil<\/b><\/div>\n<div>\u0130\u015f sahibi, edimini yerine getirmeyen y\u00fcklenici ile yapt\u0131\u011f\u0131 in\u015faat s\u00f6zle\u015fmesini ge\u00e7mi\u015fe etkili olarak bozmak ve teslim\/tamamlama tarihinden \u00f6nce y\u00fcklenici ve onun \u201calaca\u011f\u0131n temliki\u201d yoluyla ba\u011f\u0131ms\u0131z b\u00f6l\u00fcm sat\u0131p teslim etti\u011fi \u00fc\u00e7\u00fcnc\u00fc ki\u015filer ad\u0131na tesis edilen tapu kay\u0131tlar\u0131n\u0131n iptali ile kendi ad\u0131na tescilini istemekle birlikte, acaba \u00fc\u00e7\u00fcnc\u00fc ki\u015filer aleyhine tapu iptal ve tescil davas\u0131ndan ba\u015fka ecrimisil davas\u0131 da a\u00e7abilir mi?<\/div>\n<div>Ecrimisil bir haks\u0131z kullanma tazminat\u0131d\u0131r. Oysa bazen \u00fc\u00e7\u00fcnc\u00fc ki\u015filer haks\u0131z olarak de\u011fil hukuk d\u00fczenine uygun olarak (alaca\u011f\u0131n temliki veya m\u00fclkiyetin naklini sa\u011flayan resmi sat\u0131\u015f s\u00f6zle\u015fmesiyle) dava konusu ta\u015f\u0131nmaz\u0131 elinde bulundururlar. Bu durumda bir ayr\u0131m yapmal\u0131y\u0131z:<\/div>\n<div><b>1.<\/b> Dava konusu ba\u011f\u0131ms\u0131z b\u00f6l\u00fcmler \u00fc\u00e7\u00fcnc\u00fc ki\u015filere y\u00fcklenici taraf\u0131ndan \u201calaca\u011f\u0131n temliki\u201d kapsam\u0131nda adi yaz\u0131l\u0131 s\u00f6zle\u015fme ile temlik ve teslim edilmi\u015f olmakla birlikte hen\u00fcz tescil yap\u0131lmam\u0131\u015fsa: Bu durumda yaln\u0131z y\u00fcklenici aleyhine a\u00e7\u0131lacak s\u00f6zle\u015fmenin bozulmas\u0131 ve onun ad\u0131na kurulan tapular\u0131n iptali davas\u0131 sonunda \u201ctalep do\u011frultusunda\u201d verilecek \u201cs\u00f6zle\u015fmenin bozulmas\u0131 ve tapu iptal ve tescil karar\u0131\u201dn\u0131n kesinle\u015fti\u011fi tarihle birlikte, \u00fc\u00e7\u00fcnc\u00fc ki\u015filerin hukuk d\u00fczenindeki hakl\u0131l\u0131klar\u0131n\u0131 yitirmelerine neden olmaz. Bunun i\u00e7in, i\u015f sahibinin alaca\u011f\u0131n temliki s\u00f6zle\u015fmesiyle ba\u011f\u0131ms\u0131z b\u00f6l\u00fcm\u00fc kullanan \u00fc\u00e7\u00fcnc\u00fc ki\u015filer aleyhine ayr\u0131ca elatman\u0131n \u00f6nlenmesi davas\u0131 a\u00e7mas\u0131 ve bu karar\u0131 kesinle\u015ftirmesi gerekir. \u0130\u015fte ecrimisil, elatman\u0131n \u00f6nlenmesine ili\u015fkin karar\u0131n kesinle\u015fti\u011fi tarihten sonras\u0131 i\u00e7in (elatman\u0131n \u00f6nlendi\u011fi\/tahliyenin ger\u00e7ekle\u015ftirildi\u011fi tarihe kadar) s\u00f6z konusu olabilir. Hemen belirtelim ki, bu iki hukuk yolunun ayn\u0131 dava dilek\u00e7esinde istenmesine bir engel bulunmamaktad\u0131r.<\/div>\n<div><b>2.<\/b> Dava konusu ba\u011f\u0131ms\u0131z b\u00f6l\u00fcmler \u00fc\u00e7\u00fcnc\u00fc ki\u015filere y\u00fcklenici taraf\u0131ndan \u201calaca\u011f\u0131n temliki\u201d kapsam\u0131nda tapuda resmi s\u00f6zle\u015fmeyle sat\u0131lm\u0131\u015f ve teslim edilmi\u015fse: Bu durumda y\u00fcklenici ile birlikte onun ba\u011f\u0131ms\u0131z b\u00f6l\u00fcm satt\u0131\u011f\u0131 \u00fc\u00e7\u00fcnc\u00fc ki\u015filer aleyhine a\u00e7\u0131lacak s\u00f6zle\u015fmenin bozulmas\u0131 ve onlar\u0131n ad\u0131na kurulan tapular\u0131n iptali davas\u0131 sonunda \u201ctalep do\u011frultusunda\u201d verilecek \u201cs\u00f6zle\u015fmenin bozulmas\u0131 ve tapu iptal ve tescil karar\u0131\u201dn\u0131n kesinle\u015fti\u011fi tarihle birlikte, \u00fc\u00e7\u00fcnc\u00fc ki\u015filerin hukuk d\u00fczenindeki hakl\u0131l\u0131klar\u0131 sona erer. Bu durumda, elatman\u0131n \u00f6nlenmesi davas\u0131nda \u00fc\u00e7\u00fcnc\u00fc ki\u015filerin o ba\u011f\u0131ms\u0131z b\u00f6l\u00fcm\u00fc ellerinde tutmalar\u0131n\u0131n hakl\u0131 olup olmad\u0131\u011f\u0131 tart\u0131\u015f\u0131lmaz, tapu iptal karar\u0131n\u0131n kesinle\u015fmesiyle birlikte \u00fc\u00e7\u00fcnc\u00fc ki\u015filerin elleri alt\u0131ndaki ba\u011f\u0131ms\u0131z b\u00f6l\u00fcmleri i\u015f sahibine teslim etmeleri gerekir. Teslim etmezlerse, aleyhlerine elatman\u0131n \u00f6nlenmesi davas\u0131 a\u00e7\u0131larak sonuca gidilir.\u00a0\u0130\u015fte ecrimisil, bu olas\u0131l\u0131kta, tapu iptal ve tescil karar\u0131n\u0131n kesinle\u015fti\u011fi tarihten sonras\u0131 i\u00e7in (elatman\u0131n \u00f6nlendi\u011fi\/tahliyenin ger\u00e7ekle\u015ftirildi\u011fi tarihe kadar) s\u00f6z konusu olabilir.<\/div>\n<div><b>C. Proje D\u0131\u015f\u0131 \u0130malatlar \u0130\u00e7in Ecrimisil<\/b><\/div>\n<div>S\u00f6zle\u015fmeciler, proje d\u0131\u015f\u0131 imalat\u0131n yaln\u0131z bir s\u00f6zle\u015fmecinin olaca\u011f\u0131n\u0131, \u00f6b\u00fcr s\u00f6zle\u015fmecinin bu imalattan bir hak talep edemeyece\u011fini a\u00e7\u0131k\u00e7a kararla\u015ft\u0131rmam\u0131\u015flarsa; s\u00f6zle\u015fmeciler s\u00f6zle\u015fme ve ba\u015flang\u0131\u00e7ta d\u00fczenlenen projede yer almayan imalatta (projeye ayk\u0131r\u0131 olsun veya olmas\u0131n) s\u00f6zle\u015fmede belirtilen oranda hak sahibi olaca\u011f\u0131ndan, \u00f6rne\u011fin y\u00fcklenici b\u00f6yle bir yere tek ba\u015f\u0131na sahipleniyorsa, i\u015f sahibi, kullanma tazminat\u0131 (ecrimisil) isteyebilir.<\/div>\n<div><b>D. Payda\u015flar Aras\u0131nda Ecrimisil<\/b><\/div>\n<div>Payl\u0131 m\u00fclkiyete ba\u011fl\u0131 bir ta\u015f\u0131nmazda bir malikin ta\u015f\u0131nmaz\u0131 kullanan \u00f6b\u00fcr maliklerden haks\u0131z kullanma tazminat\u0131 (ecrimisil) isteyebilmesi i\u00e7in ta\u015f\u0131nmazdan yararlanma iste\u011fini kar\u015f\u0131 tarafa iletmi\u015f olmas\u0131 zorunludur. Buna \u201cintifadan men \u015fart\u0131\u201d denilmekte olup, bu ko\u015fulun ger\u00e7ekle\u015fmesi an\u0131lan tazminat istenen s\u00fcreden \u00f6nce davac\u0131 payda\u015f\u0131n davaya konu ta\u015f\u0131nmazdan ya da gelirinden yararlanmak iste\u011fini daval\u0131 payda\u015fa bildirmi\u015f olmas\u0131na ba\u011fl\u0131d\u0131r. Ba\u015fka bir anlat\u0131mla, haks\u0131z kullanma tazminat\u0131 isteminin kabul edilebilmesi i\u00e7in, yararlanman\u0131n herhangi bir nedene dayanmamas\u0131 ve bu konuda hak sahibinin \u201cmen iradesi\u201dnin kar\u015f\u0131 tarafa ula\u015ft\u0131r\u0131lmas\u0131 gerekir.<\/div>\n<div>Yararlanmas\u0131 \u00f6nlenmeyen bir payda\u015f, ecrimisil davas\u0131 a\u00e7amaz. Payda\u015f\u0131n yararlanmas\u0131n\u0131n \u00f6nlenip \u00f6nlenmedi\u011fi dava ko\u015fulu oldu\u011fundan, yarg\u0131\u00e7 taraf\u0131ndan g\u00f6revinden \u00f6t\u00fcr\u00fc g\u00f6z \u00f6n\u00fcnde bulundurmal\u0131d\u0131r. Ta\u015f\u0131nmaz\u0131n ba\u011f ve bah\u00e7e gibi do\u011fal \u00fcr\u00fcn veren ya da kiraya verilerek hukuksal semere elde edilen yerlerden olmas\u0131, payl\u0131 ta\u015f\u0131nmaz\u0131 i\u015fgal eden payda\u015f\u0131n bu ta\u015f\u0131nmaz\u0131n tamam\u0131nda hak iddia ve \u00f6b\u00fcr\u00fcn\u00fcn payda\u015fl\u0131\u011f\u0131n\u0131 ink\u00e2r etmesi, ta\u015f\u0131nmaz\u0131n ticari ama\u00e7la kullan\u0131lmas\u0131, payda\u015flar aras\u0131nda yap\u0131lan kullan\u0131m anla\u015fmas\u0131 sonucu her payda\u015f\u0131n yararlanaca\u011f\u0131 ortak ta\u015f\u0131nmaz veya b\u00f6l\u00fcmlerin belli olmas\u0131, davac\u0131 payda\u015f taraf\u0131ndan daval\u0131 payda\u015f aleyhine daha \u00f6nce o ta\u015f\u0131nmaza ili\u015fkin elatman\u0131n \u00f6nlenmesi, ortakl\u0131\u011f\u0131n giderilmesi, ecrimisil ve benzeri davalar a\u00e7\u0131lmas\u0131 durumunda \u201cyararlanman\u0131n \u00f6nlenmesi\u201d ko\u015fulunu aramaya gerek bulunmamaktad\u0131r.<\/div>\n<div>Yararlanman\u0131n \u00f6nlendi\u011fi itiraz\u0131 yemin dahil her t\u00fcrl\u00fc delille kan\u0131tlanabilir.<\/div>\n<div>Dava a\u00e7\u0131lmas\u0131, ihtarname tebli\u011f edilmi\u015f gibi, yararlanmas\u0131n\u0131n \u00f6nlendi\u011fini g\u00f6sterir.<\/div>\n<div><b>E. Hapis Hakk\u0131nda Ecrimisil<\/b><\/div>\n<div>Daval\u0131 ta\u015f\u0131nmaz\u0131 \u201chapis hakk\u0131na\u201d dayanarak elinde bulunduruyor veya kullan\u0131yorsa, bu d\u00f6nem i\u00e7in ondan ecrimisil istenemeyecektir. \u00d6rne\u011fin, ta\u015f\u0131nmaz mal\u0131 \u201charicen\u201d sat\u0131n al\u0131p da a\u00e7t\u0131\u011f\u0131 tescil davas\u0131 reddedilen bu nedenle sat\u0131\u015f bedelinin geri \u00f6denmesini isteyen ki\u015finin ta\u015f\u0131nmaz \u00fczerinde hapis hakk\u0131 vard\u0131r; bu nedenle kendisinden haks\u0131z kullanma tazminat\u0131 istenemez.<\/div>\n<div>\u0130n\u015faatlar &#8220;ka\u00e7ak&#8221; olup, daval\u0131ya, ta\u015f\u0131nmaz \u00fczerinde herhangi bir hak sa\u011flamad\u0131\u011f\u0131ndan ve iyi niyetli zilyet de say\u0131lamayaca\u011f\u0131ndan, T\u00fcrk Medeni Kanunu&#8217;nun 994. maddesi gere\u011fince ta\u015f\u0131nmaz\u0131 &#8220;al\u0131koyma&#8221; hakk\u0131 yoktur. Y\u00fcklenicinin, ta\u015f\u0131nmaz \u00fczerinde m\u00fclkiyet yahut korunmas\u0131 gereken ba\u015fkaca ayni veya \u015fahsi bir hakk\u0131n\u0131n bulunmad\u0131\u011f\u0131n\u0131n belirlenmesi durumunda, y\u00fcklenici k\u00f6t\u00fc niyetli zilyet ve haks\u0131z i\u015fgalci olur.<\/div>\n<div><b>F. A\u00e7\u0131k Veya \u00d6r\u00fcl\u00fc Onayda Ecrimisil<\/b><\/div>\n<div>Ta\u015f\u0131nmaz\u0131n kullan\u0131lmas\u0131na uzunca bir s\u00fcre kar\u015f\u0131 \u00e7\u0131k\u0131lmam\u0131\u015fsa, bu, onay verildi\u011fini g\u00f6sterir. Yaz\u0131l\u0131 veya s\u00f6zl\u00fc, a\u00e7\u0131k veya \u00f6r\u00fcl\u00fc olarak verilen onay bir ihtarname veya a\u00e7\u0131lan bir dava ile geri al\u0131nabilir. Ecrimisil ancak, onay\u0131n geri al\u0131nd\u0131\u011f\u0131 tarihten sonras\u0131 i\u00e7in s\u00f6z konusu olabilir.<\/div>\n<div>Ta\u015f\u0131nmaz\u0131 \u201charicen sat\u0131n alan ki\u015fi, elatman\u0131n \u00f6nlenmesi davas\u0131 a\u00e7\u0131l\u0131ncaya kadar iyi niyetli zilyet kabul edilmelidir: Davac\u0131 ta\u015f\u0131nmaz\u0131 \u201charicen\u201d daval\u0131ya satm\u0131\u015f ve zilyetli\u011fini de devretmi\u015fse, ecrimisil isteyemeyecektir.<\/div>\n<div><b>G.Apartman\u0131n Ortak Yerlerinin Kullan\u0131lmas\u0131nda Ecrimisil\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0<\/b><\/div>\n<div>Y\u00fcklenici, projeye ayk\u0131r\u0131 olarak, yap\u0131n\u0131n ortak yerlerini, ba\u011f\u0131ms\u0131z b\u00f6l\u00fcmler olu\u015fturarak veya olu\u015fturmayarak, kullanmakta veya kiraya vererek gelir elde etmekteyse ya da arsa sahibinin kullanmas\u0131na engel oluyorsa, arsa sahibi veya ard\u0131llar\u0131 ondan &lt;arsa pay\u0131 oran\u0131nda&gt; kullanma tazminat\u0131 isteyebilirler.<\/div>\n<div>\u00d6zel ortak ama\u00e7lara \u00f6zg\u00fclenmi\u015f ortak yerlerin (\u00f6rne\u011fin s\u0131\u011f\u0131na\u011f\u0131n) bu \u00f6zel amaca \u00f6zg\u00fclemesi kald\u0131r\u0131lmad\u0131\u011f\u0131 s\u00fcrece herhangi bir gelir getirmesi ve t\u00fcm kat maliklerinin oybirli\u011fiyle karar almas\u0131 halinde dahi kiraya verilmesi olanakl\u0131 bulunmad\u0131\u011f\u0131ndan bu gibi yerlerin i\u015fgali nedeniyle ecrimisil istenemez.<\/div>\n<div><b>H. Haks\u0131z Kullanan\u00a0Ki\u015filerin \u0130steyebilece\u011fi Giderler<\/b><\/div>\n<div>Hemen belirtelim ki, \u00fc\u00e7\u00fcnc\u00fc ki\u015filer, yasal bir yap\u0131da, ellerinden al\u0131nan ba\u011f\u0131ms\u0131z b\u00f6l\u00fcmler i\u00e7in yapt\u0131klar\u0131 yararl\u0131 ve zorunlu giderleri i\u015f sahibinden isteyebilirler. Hatta TMK. md. 994\/I gere\u011fince, bu ama\u00e7la a\u00e7\u0131lan dava sonu\u00e7lan\u0131ncaya ve giderler \u00f6deninceye kadar ba\u011f\u0131ms\u0131z b\u00f6l\u00fcmleri ellerinde tutma, yani teslim etmeme hakk\u0131na sahiptirler.<\/div>\n<div>Yasal olmayan bir binada ise, \u00fc\u00e7\u00fcnc\u00fc ki\u015filer, e\u011fer ko\u015fullar ger\u00e7ekle\u015fmi\u015fse, yaln\u0131z \u201ckullanma yarar\u0131 tazminat\u0131\u201d isteyebilirler. \u015e\u00f6yle ki, \u00fc\u00e7\u00fcnc\u00fc ki\u015filer yasal olmayan bir yap\u0131daki ba\u011f\u0131ms\u0131z b\u00f6l\u00fcmlere \u00f6yle zorunlu giderler yapm\u0131\u015flard\u0131r ki i\u015f sahibi, yap\u0131 yasal olmamas\u0131na kar\u015f\u0131n, bunlar\u0131n sayesinde ba\u011f\u0131ms\u0131z b\u00f6l\u00fcmleri kullanmakta ve ondan yararlanmaktad\u0131r; \u00f6rne\u011fin kira paras\u0131 almakta\u00a0veya eylemli olarak kullanmaktad\u0131r. \u0130\u015fte \u00fc\u00e7\u00fcnc\u00fc ki\u015filer ve y\u00fcklenici, i\u015f sahibinden a\u00e7\u0131klad\u0131\u011f\u0131m\u0131z kapsamda \u201ckullanma yarar\u0131\u201d tazminat\u0131 isteyebilirler. Bu tazminat\u0131n hesaplanaca\u011f\u0131 d\u00f6nem, i\u015f sahibinin kullanmaya\/yararlanmaya (\u00f6rne\u011fin kira paras\u0131 almaya) ba\u015flad\u0131\u011f\u0131 tarihten kullanman\u0131n sona erdi\u011fi (\u00f6rne\u011fin kamu makamlar\u0131n\u0131n kullan\u0131m\u0131 \u00f6nledi\u011fi, y\u0131kt\u0131\u011f\u0131, bo\u015faltt\u0131\u011f\u0131) tarihe kadar s\u00fcrer. Bu a\u00e7\u0131klamadan anla\u015f\u0131lmaktad\u0131r ki, \u201ckullanma yarar\u0131 tazminat\u0131\u201d ile \u201czorunlu ve yararl\u0131 giderler\u201d ayn\u0131 anlama gelmemektedir.<\/div>\n<div><b>I. Ecrismil Davas\u0131yla \u0130\u015fgale Devam Edilmesi<\/b><\/div>\n<div>Davac\u0131n\u0131n elatman\u0131n \u00f6nlenmesi davas\u0131 a\u00e7mayarak daval\u0131lar\u0131n i\u015fgalleri sonucu meydana gelen de\u011fer art\u0131\u015f\u0131 ve ranttan haks\u0131z yere yararlanmas\u0131 olana\u011f\u0131 veren ecrimisil davas\u0131n\u0131 a\u00e7mas\u0131, TMK. md. 2\u2019de belirtilen d\u00fcr\u00fcstl\u00fck kurallar\u0131yla ba\u011fda\u015fmaz. Yarg\u0131tay bir karar\u0131nda bu konuyu \u015f\u00f6yle a\u00e7\u0131klam\u0131\u015ft\u0131r: Ne var ki davac\u0131n\u0131n m\u00fclkiyet hakk\u0131n\u0131n Anayasa ve Yasalarla korundu\u011fu ve onlar\u0131n g\u00fcvencesi alt\u0131nda bulundu\u011fu da bir ger\u00e7ektir. Bu ger\u00e7ekten hareketle yukar\u0131daki a\u00e7\u0131klamalar ve saptamalar \u0131\u015f\u0131\u011f\u0131nda konuya m\u00fclkiyet hakk\u0131 a\u00e7\u0131s\u0131ndan bak\u0131ld\u0131\u011f\u0131nda, davac\u0131n\u0131n m\u00fclkiyet hakk\u0131n\u0131 korumak ve vaki oldu\u011fu anla\u015f\u0131lan m\u00fcdahalenin \u00f6nlenmesi i\u00e7in dava a\u00e7abilece\u011fi tabiidir. M\u00fcdahalenin \u00f6nlenmesi davas\u0131, daval\u0131 durumunda olacak olan \u015fagillere hem bir ihtar olacak hem de kanundan do\u011fabilecek haklar\u0131n\u0131n korunmas\u0131 i\u00e7in kar\u015f\u0131l\u0131k dava a\u00e7ma veya bu haklar\u0131n saptama olana\u011f\u0131n\u0131 verecektir. Bu suretle, yani m\u00fcdahalenin \u00f6nlenmesi davas\u0131n\u0131n a\u00e7\u0131lmas\u0131yla \u015fagil daval\u0131lar, art\u0131k yukar\u0131da a\u00e7\u0131klanan gerek\u00e7elerle ecrimisil tazminat\u0131n\u0131n dayana\u011f\u0131 olan k\u00f6t\u00fc niyetini mevcut olmad\u0131\u011f\u0131 sav\u0131n\u0131 ileri s\u00fcremezler. Bu sonucun de\u011fi\u015fik a\u00e7\u0131dan anlam\u0131, niteli\u011fi ve s\u00fcresi yukar\u0131da belirlenmi\u015f oldu\u011fu \u015fekilde olan i\u015fgallerde, ecrimisil ancak Meni m\u00fcdahale davas\u0131yla birlikte ve ondan sonra s\u00f6z konusu olabilir. An\u0131lan davadan \u00f6nce a\u00e7\u0131lacak bir ecrimisil davas\u0131, daval\u0131lar\u0131n i\u015fgalleri s\u00fcreci i\u00e7erisinde ta\u015f\u0131nmaza kazand\u0131rd\u0131klar\u0131 de\u011fer ve rant\u0131n haks\u0131z olarak davac\u0131ya aktar\u0131lmas\u0131na yol a\u00e7ar. \u0130\u015fgal olmasayd\u0131 tarla niteli\u011finde kalacak olan bir ta\u015f\u0131nmaz\u0131n i\u015fgali ile kazand\u0131\u011f\u0131 de\u011fer artt\u0131r\u0131c\u0131 nitelikler nedeniyle davac\u0131n\u0131n ecrimisil davalar\u0131yla s\u00fcrekli yarar sa\u011flanmas\u0131 hakkaniyete ve objektif iyi niyet kurallar\u0131na uygun d\u00fc\u015fmez. \u0130yi niyetli malik, bu t\u00fcr niteliklere sahip ta\u015f\u0131nmazlardaki m\u00fclkiyet hakk\u0131n\u0131n korunmas\u0131n\u0131 istiyor ise, vaki tecav\u00fcz\u00fcn \u00f6nlenmesi i\u00e7in dava a\u00e7mal\u0131d\u0131r. Aksi halde, daval\u0131lar\u0131n zaman\u0131nda iyi niyetle emek ve varl\u0131klar\u0131n\u0131 katarak olu\u015fturduklar\u0131 de\u011fer art\u0131\u015f\u0131ndan s\u00fcrekli yararlanma sa\u011flayan ecrimisil davalar\u0131 tevvali edecek, davac\u0131 katk\u0131s\u0131 bulunmayan de\u011fer art\u0131\u015flar\u0131ndan haks\u0131z yere yararlanm\u0131\u015f olacakt\u0131r. Ecrimisilin bilirki\u015finin yapt\u0131\u011f\u0131 gibi binalar dahil edilmeyerek yaln\u0131z arz \u00fczerine hesaplanm\u0131\u015f olmas\u0131 yukar\u0131da s\u00f6z\u00fc edilen haks\u0131zl\u0131klar\u0131 ve sak\u0131ncalar\u0131 bertaraf edemez. \u00c7\u00fcnk\u00fc, arz\u0131n getirebilece\u011fi ecrimisilin, mevcut olan alt yap\u0131 belediye hizmetleri ve genel olarak \u015fehirle\u015fme unsurlar\u0131n\u0131n d\u0131\u015flanmas\u0131 suretiyle belirlenmesi m\u00fcmk\u00fcn olamayacakt\u0131r. Bu durumda davac\u0131n\u0131n Meni m\u00fcdahale davas\u0131 a\u00e7mayarak daval\u0131lar\u0131n bizatihi i\u015fgalleri sonucu meydana gelen de\u011fer art\u0131\u015f\u0131 ve ranttan haks\u0131z yere yararlanma olana\u011f\u0131n\u0131 veren ecrimisil davas\u0131n\u0131 a\u00e7mas\u0131, Medeni Kanunu\u2019nun 2. maddesinde h\u00fckm\u00fc ba\u011flanan iyi niyet kurallar\u0131yla da ba\u011fda\u015fmaz. O halde davac\u0131 m\u00fclkiyet hakk\u0131na dayanarak ancak uygun ko\u015fullarla \u015fagiller hakk\u0131nda m\u00fcdahalenin \u00f6nlenmesi davas\u0131 a\u00e7abilir. Ecrimisil tazminat\u0131n\u0131n iki ana ko\u015fulu olan daval\u0131n\u0131n k\u00f6t\u00fc niyeti ve davac\u0131n\u0131n kabul\u00fcne karar verilmesi do\u011fru g\u00f6r\u00fclmemi\u015ftir.\u201d<\/div>\n<div><b>III. Hesab\u0131n \u0130lkeleri<\/b><\/div>\n<div>A. Hesap Yap\u0131lacak S\u00fcre: Davac\u0131 ta\u015f\u0131nmaza s\u00f6z gelimi 1.1.2007 tarihinde kesinle\u015fen kararla malik olmu\u015ftur. Bu tarihle dava tarihi aras\u0131ndaki s\u00fcre i\u00e7in ecrimisil bedeline h\u00fckmedilmesi gerekirken, dava tarihinden geriye do\u011fru 5 y\u0131ll\u0131k ecrimisil bedeline h\u00fckmedilmesi do\u011fru de\u011fildir.<\/div>\n<div>B. Ecrimisil k\u00f6t\u00fc niyetli \u015fagilin \u00f6demekle sorumlu oldu\u011fu tazminat olup, en az\u0131 kira geliri, en \u00e7o\u011fu ise tam gelir yoksunlu\u011fudur.<\/div>\n<div>C. Ecrimisil \u00f6demekle y\u00fck\u00fcml\u00fc olan ki\u015fi, ancak i\u015fgal edip yararland\u0131\u011f\u0131 k\u0131s\u0131mdan sorumludur.<\/div>\n<div>D. Haks\u0131z kullanma tazminat\u0131, dava tarihine kadar h\u00fck\u00fcm alt\u0131na al\u0131nmal\u0131d\u0131r.<\/div>\n<div>E. Haks\u0131z kullanma tazminat\u0131n\u0131n, bilirki\u015filer taraf\u0131ndan, emsal ta\u015f\u0131nmazlardan da yararlanarak, daval\u0131 i\u015fgal etmese idi davac\u0131n\u0131n ta\u015f\u0131nmazdan sa\u011flayaca\u011f\u0131 yararlar\u0131n hesaplanmas\u0131 gerekir. Ba\u015fka bir anlat\u0131mla, yarg\u0131\u00e7 g\u00f6revinden \u00f6t\u00fcr\u00fc veya genel hayat ve hukuk deneyimlerine dayanarak bu tazminat\u0131 hesaplamayacakt\u0131r.<\/div>\n<div>F. Haks\u0131z i\u015fgal edilen yerin TMK. md. 995\u2019te belirlendi\u011fi \u00fczere bir ekonomik yarar sa\u011flayacak nitelikte olmas\u0131 gerekir. \u00d6rne\u011fin, daval\u0131n\u0131n haks\u0131z olarak i\u015fgal etti\u011fi yer kendisinin de payda\u015f olarak yararlanma hakk\u0131na sahip oldu\u011fu ortak yerlerden olan teras olup bu teras\u0131n davac\u0131ya ne suretle yararlanmas\u0131 halinde bir fayda sa\u011flayaca\u011f\u0131n\u0131n kan\u0131tlanmas\u0131 gerekir.<\/div>\n<div><b>VI. Faiz<\/b><\/div>\n<div>Ecrimisil davalar\u0131nda faize, her y\u0131l veya d\u00f6nemin sonundan ba\u015flayarak kademeli olarak h\u00fckmedilmesi gerekir.<\/div>\n<div><b>V. Zamana\u015f\u0131m\u0131<\/b><\/div>\n<div><b>A. Genel Olarak Ecrimisil Davalar\u0131nda Zamana\u015f\u0131m\u0131<\/b><\/div>\n<div>\u0130\u015fgal tazminat\u0131 davalar\u0131n\u0131n \u00f6zel bir bi\u00e7imi olan ecrimisil davalar\u0131 be\u015f y\u0131lda zamana\u015f\u0131m\u0131na u\u011frar.<\/div>\n<div><b>B. TMK. md. 995\u2019e Dayanan Ecrimisil Davalar\u0131nda Zamana\u015f\u0131m\u0131<\/b><\/div>\n<div>Medeni Kanunun 908. Maddesine giren davalardan (ecrimisil davalar\u0131 d\u0131\u015f\u0131nda) TMK. md. 995\u2019e dayanan tazmin davalar\u0131, niteli\u011fi bak\u0131m\u0131ndan zilyedin haks\u0131z eyleminden do\u011fan tazminat davalar\u0131 olduklar\u0131ndan, BK. md. 60\u2019ta g\u00f6sterilen zamana\u015f\u0131mlar\u0131na, BK. md. 414\u2019e dayanan alacaklar ise BK. md. 125\u2019te g\u00f6sterilen zamana\u015f\u0131m\u0131na ba\u011fl\u0131 olacaklar\u0131ndan davan\u0131n kesin ve a\u00e7\u0131k olarak davac\u0131 taraf\u00e7a veya teredd\u00fct halinde yarg\u0131\u00e7 taraf\u0131ndan \u015fu veya bu bi\u00e7imde nitelendirilmesi, zamana\u015f\u0131m\u0131 bak\u0131m\u0131ndan son derece \u00f6nemlidir. Teredd\u00fct halinde bu dava, vekilliksiz i\u015fg\u00f6rmeye ili\u015fkin BK. md. 414\u2019e dayanan bir dava say\u0131laca\u011f\u0131ndan on y\u0131ll\u0131k zamana\u015f\u0131m\u0131na ve TMK. md. 995\u2019e dayanan bir dava olarak nitelendirilmesi durumlar\u0131nda ise, BK. md. 60\u2019taki 1 ve 10 y\u0131ll\u0131k zamana\u015f\u0131m\u0131na ve olay\u0131na g\u00f6re ceza zamana\u015f\u0131m\u0131na ba\u011fl\u0131 olacakt\u0131r.<\/div>\n<div><b>3. BK. md. 414\u2019e Dayanan Ecrimisil Davalar\u0131nda Zamana\u015f\u0131m\u0131<\/b><\/div>\n<div>Bir kimsenin ba\u015fkas\u0131na ait oldu\u011funu bildi\u011fi veya bilebilecek durumda bulundu\u011fu bir ta\u015f\u0131nmaz\u0131 kendi mal\u0131 imi\u015f gibi kiraya verip kiralar\u0131 toplam\u0131\u015f olmas\u0131 nedeniyle hak sahibinin o kimseden kiralar\u0131n al\u0131nmas\u0131 i\u00e7in a\u00e7aca\u011f\u0131 davan\u0131n gerek Bor\u00e7lar Kanunun 414. maddesine dayanan, gerekse TMK. md. 995\u2019e dayanan bir dava olarak nitelendirilmesi olana\u011f\u0131 bulunmaktad\u0131r. Teredd\u00fct halinde, Bor\u00e7lar Kanununun 414. maddesi h\u00fckm\u00fcne dayanan yararlar\u0131n devri davas\u0131 say\u0131l\u0131r.\u00a0Bundan dolay\u0131 on y\u0131ll\u0131k zamana\u015f\u0131m\u0131na ba\u011fl\u0131d\u0131r.<\/div>\n<div><b>VI.<\/b><b>G\u00f6revli Mahkeme<\/b><\/div>\n<div>\u00a0\u0130ster tek ba\u015f\u0131na a\u00e7\u0131ls\u0131n, ister elatman\u0131n \u00f6nlenmesi veya tapu iptal ve tescil davas\u0131yla a\u00e7\u0131ls\u0131n, ecrimisil davalar\u0131 davan\u0131n de\u011ferine g\u00f6re belirlenir; de\u011ferine g\u00f6re Asliye Hukuk veya Sulh Hukuk Mahkemelerinde bak\u0131l\u0131r.<\/div>\n<div>Tapu iptal ve tescil, elatman\u0131n \u00f6nlenmesi ve ecrimisil davalar\u0131n\u0131n birlikte a\u00e7\u0131lmas\u0131 durumunda, mahkemenin \u00f6nce tapu iptal ve tescil veya elatman\u0131n \u00f6nlenmesi istemlerini incelemesi, davac\u0131n\u0131n ta\u015f\u0131nmazla hakl\u0131 ve \u00fcst\u00fcn ba\u011f\u0131n\u0131 saptad\u0131ktan sonra, haks\u0131z kullanma tazminat\u0131 istemini incelemeye ge\u00e7mesi gerekir.<\/div>\n<div>Kat M\u00fclkiyeti Kanunundan do\u011fan uyu\u015fmazl\u0131klar, miktar\u0131na bak\u0131lmaks\u0131z\u0131n Sulh Hukuk Mahkemesinde g\u00f6r\u00fcl\u00fcr. Ecrimisil davalar\u0131nda g\u00f6revli mahkeme ise dava de\u011feri ile ilgilidir. Ortak yere m\u00fcdahalenin \u00f6nlenmesi ve ecrimisil davas\u0131nda, talep konusu mebla\u011f Asliye Hukuk Mahkemesinin g\u00f6revine giriyorsa; ecrimisil davas\u0131 ayr\u0131larak Asliye Hukuk Mahkemesinde bak\u0131lmak \u00fczere dava dilek\u00e7esinin reddine karar verilmelidir.<\/div>\n<div><b>VII. Yetkili Mahkeme<\/b><\/div>\n<div>Ecrimisil davalar\u0131na bakmaya ta\u015f\u0131nmaz\u0131n bulundu\u011fu yer mahkemesi veya daval\u0131n\u0131n ikametgah\u0131 mahkemesi yetkilidir.<\/div>\n<div><b>VIII. Davac\u0131<\/b><\/div>\n<div>Ecrimisil davalar\u0131nda davac\u0131, ta\u015f\u0131nmaz\u0131 haks\u0131z olarak i\u015fgal edilen veya elat\u0131p kullan\u0131lan ger\u00e7ek veya t\u00fczelki\u015filerdir.<\/div>\n<div><b>IX. Daval\u0131<\/b><\/div>\n<div>Ecrimisil davalar\u0131nda daval\u0131, ta\u015f\u0131nmaz\u0131 haks\u0131z olarak kullanan\/kullananlar, elat\u0131p kullanarak yarar sa\u011flayanlard\u0131r.<\/div>\n<div><b>X. Hesab\u0131n T\u00fcrk Liras\u0131 \u00dczerinden Yap\u0131lmas\u0131<\/b><\/div>\n<div>Hesab\u0131n T\u00fcrk Liras\u0131 \u00fczerinden yap\u0131lmas\u0131 gerekir. Yarg\u0131tay bir karar\u0131nda konuyu \u015f\u00f6yle a\u00e7\u0131klam\u0131\u015ft\u0131r:: <i>\u201c\u0130lke olarak kira geliri \u00fczerinden ecrimisilin belirlenmesinde; ta\u015f\u0131nmaz\u0131n dava konusu d\u00f6nemde, mevcut haliyle serbest ko\u015fullarda getirebilece\u011fi kira paras\u0131n\u0131n, sonraki d\u00f6nemler i\u00e7in ise bulunan bu miktara Toptan E\u015fya Fiyat Endeksinin tamam\u0131 yans\u0131t\u0131lmak suretiyle bulunacak miktardan az olmamak ko\u015fuluyla bulunacak ecrimisilin h\u00fck\u00fcm alt\u0131na al\u0131nmas\u0131 gerekir. Haks\u0131z fiil benzeri olan ecrimisil \/8.3.1950-22\/4 say\u0131l\u0131 \u0130BK ) istemine ili\u015fkin ecrimisil davalar\u0131nda \u00f6nem ta\u015f\u0131yan di\u011fer bir y\u00f6n de ecrimisil miktar\u0131n\u0131n T\u00fcrk Paras\u0131 \u00fczerinden belirlenmesi gerekti\u011fidir. Zira. Bor\u00e7lar Kanununun 83. maddesi ile ancak s\u00f6zle\u015fmeye dayanan bor\u00e7lar\u0131n yabanc\u0131 para ile \u00f6denmesi hususu d\u00fczenlenmi\u015f bulunmaktad\u0131r. Gerek\u00e7esiyle\u201d davan\u0131n reddi cihetine gidilmi\u015f, h\u00fck\u00fcm davac\u0131lar vekili taraf\u0131ndan s\u00fcresinde temyiz edilmi\u015ftir.<\/div>\n<div style=\"text-align: justify;\">\n<p>Davac\u0131lar, malik olduklar\u0131 binan\u0131n bodrum kat\u0131n\u0131n daval\u0131 taraf\u0131ndan kira s\u00f6zle\u015fmesi kapsam\u0131 d\u0131\u015f\u0131nda kullan\u0131ld\u0131\u011f\u0131n\u0131, kar\u015f\u0131l\u0131\u011f\u0131nda bir \u00fccret \u00f6denmedi\u011fini iddia ederek; haks\u0131z kullan\u0131m kar\u015f\u0131l\u0131\u011f\u0131, ecrimisil talep etmektedirler.<\/p>\n<p>Bilindi\u011fi gibi, gerek \u00f6\u011fretide ve gerekse yarg\u0131sal uygulamalarda ifade edildi\u011fi \u00fczere, ecrimisil; (di\u011fer bir deyi\u015fle i\u015fgal tazminat\u0131) hak sahibinin k\u00f6t\u00fcniyetli zilyetten isteyebilece\u011fi bir tazminat olup, 08.03.1950 tarih 22\/4 say\u0131l\u0131 \u0130nan\u00e7lar\u0131 Birle\u015ftirme Karar\u0131nda \u201c&#8230;fuzuli i\u015fgalin kiraya benzetilemeyece\u011fi, haks\u0131z bir eylem say\u0131lmas\u0131 gerekti\u011fi&#8230;.bir zarar meydana gelirse bunun tazmin ettirilece\u011fi,&#8230;Medeni Kanunun (eski) 908.maddesi anlam\u0131nda zilyedin faydalanmas\u0131ndan do\u011fan bir istem oldu\u011fu&#8230;\u201d vurgulanm\u0131\u015ft\u0131r. Ecrimisil, haks\u0131z i\u015fgal nedeniyle tazminat olarak nitelendirilen \u00f6zel bir zarar giderim bi\u00e7imi olmas\u0131 nedeniyle, en az\u0131 kira geliri, en \u00e7o\u011fu ise tam gelir yoksunlu\u011fu kar\u015f\u0131l\u0131\u011f\u0131 zarard\u0131r.<\/p>\n<p>Somut olayda; daval\u0131n\u0131n, kiralad\u0131\u011f\u0131 zemin kattaki asma katl\u0131 d\u00fckk\u00e2n\u0131, (bina projesinde ba\u011f\u0131ms\u0131z b\u00f6l\u00fcm olarak g\u00f6sterilmeyen) bodrum katla ili\u015fkilendirerek (ekonomik fayda sa\u011flamak amac\u0131yla) birlikte kulland\u0131\u011f\u0131; buna kar\u015f\u0131l\u0131k, davac\u0131lar\u0131n bu kullan\u0131m nedeniyle bir zarar\u0131n\u0131n do\u011fdu\u011fu anla\u015f\u0131lmaktad\u0131r. Mahkemece, daval\u0131 taraf\u0131ndan yararlan\u0131lan ve haks\u0131z olarak kullan\u0131lan bu yerin, bodrum kat olup projede s\u0131\u011f\u0131nak olarak yer alan ortak kullan\u0131m alan\u0131nda kald\u0131\u011f\u0131, d\u0131\u015far\u0131ya \u00e7\u0131k\u0131\u015f kap\u0131s\u0131n\u0131n bulunmad\u0131\u011f\u0131, kiraya verilme ve gelir sa\u011flama olana\u011f\u0131 bulunan yerlerden olmad\u0131\u011f\u0131ndan bahisle, ecrimisil talebinin reddine karar verilmi\u015ftir. Oysa, bir kimsenin ba\u015fkas\u0131na ait oldu\u011funu bildi\u011fi ta\u015f\u0131nmaz\u0131; hukuki bir dayana\u011f\u0131 olmadan kendi mal\u0131 gibi kullanmas\u0131 ve dolay\u0131s\u0131yla ekonomik yarar sa\u011flamas\u0131n\u0131n bir kar\u015f\u0131l\u0131\u011f\u0131 olmal\u0131d\u0131r.<\/p>\n<p>Bir nesneye (ta\u015f\u0131nmaza) haks\u0131z olarak k\u00f6t\u00fcniyetle, kendi \u00e7\u0131kar\u0131na zilyet olan kimse, onu hak sahibine geri vermekle y\u00fck\u00fcml\u00fcd\u00fcr.<\/p>\n<p>Bundan ayr\u0131 olarak, kendi \u00e7\u0131kar\u0131na haks\u0131z olarak ba\u015fkas\u0131n\u0131n hukuk alan\u0131na girip, i\u015fine kar\u0131\u015f\u0131p kazan\u00e7 elde eden kimse (daval\u0131), hak sahibinin (davac\u0131n\u0131n) tazminat davas\u0131ndaki gibi zarar\u0131 ya da nedensiz zenginle\u015fmedeki gibi yoksulla\u015fmas\u0131 aranmaks\u0131z\u0131n &#8211; Bu \u201chaks\u0131z kar\u0131\u015fma kazanc\u0131\u201dn\u0131 geri vermesi gerekmektedir (Tando\u011fan, Haluk:Mukayeseli Hukuk ve Hususiyle \u0130svi\u00e7re-T\u00fcrk Hukuku bak\u0131m\u0131ndan Vekaletsiz \u0130\u015fg\u00f6rme, \u0130st.1957, sh, 56 vd; 60\/61, 64\/66 da an\u0131lan yazarlar. O kadar ki, haks\u0131z olarak kullan\u0131lan ta\u015f\u0131nmaz\u0131n ekonomik tahsis amac\u0131 itibariyle (somut olayda projede s\u0131\u011f\u0131nak) gelir elde etmeye \u00f6rg\u00fctlenmemi\u015f olmas\u0131 dahi sonuca etkili g\u00f6r\u00fclmemelidir. \u00d6yleyse, dava konusu daval\u0131n\u0131n elinde tuttu\u011fu ta\u015f\u0131nmaz\u0131n; kiraya verilmesi halinde piyasa ko\u015fullar\u0131na g\u00f6re ne kadar bedel getirece\u011fi bilirki\u015fi eliyle belirlenmeli ve sonucuna g\u00f6re bir h\u00fck\u00fcm kurulmal\u0131d\u0131r.<\/p>\n<p>Mahkemece, yan\u0131lg\u0131l\u0131 de\u011ferlendirme ve eksik inceleme sonucu yaz\u0131l\u0131 \u015fekilde, davan\u0131n reddine karar verilmesi do\u011fru g\u00f6r\u00fclmemi\u015f, bozmay\u0131 gerektirmi\u015ftir&#8230;)<br \/>\ngerek\u00e7esiyle bozularak dosya yerine geri \u00e7evrilmekle, yeniden yap\u0131lan yarg\u0131lama sonunda, mahkemece \u00f6nceki kararda direnilmi\u015ftir.<\/p>\n<p>HUKUK GENEL KURULU KARARI<\/p>\n<p>Hukuk Genel Kurulu\u2019nca incelenerek direnme karar\u0131n\u0131n s\u00fcresinde temyiz edildi\u011fi anla\u015f\u0131ld\u0131ktan ve dosyadaki k\u00e2\u011f\u0131tlar okunduktan sonra gere\u011fi g\u00f6r\u00fc\u015f\u00fcld\u00fc:<\/p>\n<p>Dava, haks\u0131z i\u015fgal iddias\u0131na dayal\u0131 ecrimisil istemine ili\u015fkindir.<\/p>\n<p>Davac\u0131lar vekili; daval\u0131 kirac\u0131n\u0131n kira s\u00f6zle\u015fmesi d\u0131\u015f\u0131nda kalan b\u00f6l\u00fcm\u00fc, kiralanan alanlar ile birle\u015ftirmek suretiyle kulland\u0131\u011f\u0131n\u0131 ileri s\u00fcrerek ecrimisil iste\u011finde bulunmu\u015ftur.<\/p>\n<p>Daval\u0131 vekili; bir kimsenin ba\u015fkas\u0131na ait oldu\u011funu bildi\u011fi ta\u015f\u0131nmaz\u0131, hukuki bir dayana\u011f\u0131 olmadan kendi mal\u0131 gibi kullanmas\u0131 ve dolay\u0131s\u0131yla ekonomik yarar sa\u011flamas\u0131n\u0131n bir kar\u015f\u0131l\u0131\u011f\u0131n\u0131n olmas\u0131 gerekti\u011fi, bu bak\u0131mdan bu yeri kullanan ki\u015finin hak sahiplerine haks\u0131z i\u015fgal tazminat\u0131 \u00f6demek zorunda oldu\u011fu, haks\u0131z olarak kullan\u0131lan ta\u015f\u0131nmaz\u0131n ekonomik tahsis amac\u0131 itibariyle gelir elde etmeye \u00f6zg\u00fclenmemi\u015f olmas\u0131n\u0131n sonuca etkili bulunmamas\u0131na g\u00f6re, \u00d6zel Daire bozma karar\u0131na uyulmas\u0131 gerekirken, aksine d\u00fc\u015f\u00fcncelerle \u00f6nceki kararda direnilmesinin usul ve yasaya ayk\u0131r\u0131d\u0131r.<\/p>\n<p>Yap\u0131lan g\u00f6r\u00fc\u015fmeler s\u0131ras\u0131nda, bir k\u0131s\u0131m \u00fcyelerce, dava konusu b\u00f6l\u00fcm\u00fcn projesinde s\u0131\u011f\u0131nak oldu\u011fu, kat m\u00fclkiyeti kanununa g\u00f6re amac\u0131 d\u0131\u015f\u0131nda kullan\u0131lmayaca\u011f\u0131, niteli\u011fi itibariyle gelir getiren yer olarak de\u011ferlendirilemeyece\u011finden davan\u0131n reddine karar verilmesinin usul ve yasaya uygun bulundu\u011fu ileri s\u00fcr\u00fclm\u00fc\u015f ise de, bu g\u00f6r\u00fc\u015f Kurul \u00e7o\u011funlu\u011funca yukar\u0131da belirtilen nedenlerle benimsenmemi\u015ftir.<\/p>\n<p>O halde, Hukuk Genel Kurulu \u00e7o\u011funlu\u011funca da benimsenen \u00d6zel Daire bozma karar\u0131na uyulmas\u0131 gerekirken, \u00f6nceki kararda direnilmesi usul ve yasaya ayk\u0131r\u0131 oldu\u011fundan direnme karar\u0131 bozulmal\u0131d\u0131r.<\/p>\n<p><strong>S O N U \u00c7<\/strong> : Davac\u0131lar vekilinin temyiz itirazlar\u0131n\u0131n kabul\u00fc ile direnme karar\u0131n\u0131n Hukuk Genel Kurulu taraf\u0131ndan da benimsenen \u00d6zel Dairenin bozma karar\u0131nda g\u00f6sterilen nedenlerden dolay\u0131 6217 say\u0131l\u0131 Kanunun 30.maddesi ile 6100 say\u0131l\u0131 Hukuk Muhakemeleri Kanunu\u2019na eklenen \u201cGe\u00e7ici madde 3\u201d atf\u0131yla uygulanmakta olan 1086 say\u0131l\u0131 Hukuk Usul\u00fc Muhakemeleri Kanunu\u2019nun 429.maddesi gere\u011fince BOZULMASINA, istek halinde temyiz pe\u015fin harc\u0131n\u0131n yat\u0131rana geri verilmesine, ayn\u0131 kanunun 440\/I.maddesi uyar\u0131nca tebli\u011fden itibaren 15 g\u00fcn i\u00e7inde karar d\u00fczeltme yolu a\u00e7\u0131k olmak \u00fczere, 19.03.2014 g\u00fcn\u00fcnde yap\u0131lan g\u00f6r\u00fc\u015fmede oy\u00e7oklu\u011fu ile karar verildi.<\/p>\n<p><em><span style=\"color: #800000;\">KAR\u015eI OY<\/span><\/em><\/p>\n<p>Dava, haks\u0131z i\u015fgal nedeniyle ecrimisil talebine ili\u015fkindir.<\/p>\n<p>Uyu\u015fmazl\u0131k, yap\u0131 projesinde s\u0131\u011f\u0131nak olarak g\u00f6sterilen ve ortak m\u00fclkiyet h\u00fck\u00fcmlerine t\u00e2bi olan yerin ecrimisile tahamm\u00fcll\u00fc olup olamayaca\u011f\u0131, buradan var\u0131lacak sonuca g\u00f6re daval\u0131n\u0131n kullan\u0131m\u0131ndan dolay\u0131 ecrimisil \u00f6demesi gerekip gerekmeyece\u011fi noktas\u0131nda toplanmaktad\u0131r.<\/p>\n<p>Davac\u0131 vekili dava dilek\u00e7esinde \u00f6zetle; &#8230; Cad. No:57 &#8230;\/&#8230;adresinde bulunan ta\u015f\u0131nmazlar\u0131n\u0131 01.12.2001 ba\u015flang\u0131\u00e7 tarihli kira s\u00f6zle\u015fmesi ile daval\u0131ya kiralad\u0131klar\u0131n\u0131, kira s\u00f6zle\u015fmesi gere\u011fince ta\u015f\u0131nmazda zemin kat 1 nolu asma katl\u0131 d\u00fckkan ve 1. katta bulunan 2, 3, 4, 5, 6 ve 7 nolu b\u00fcro vas\u0131fl\u0131 ba\u011f\u0131ms\u0131z b\u00f6l\u00fcmlerin kiraya verilmesine ra\u011fmen daval\u0131 banka \u015fubesinin vekil edenlerine ait bodrum kat\u0131 da kiralanan alanlar ile birle\u015ftirmek suretiyle kullanmaya ba\u015flad\u0131\u011f\u0131n\u0131, vekil edenlerinin 01.12.2001 tarihinden bu yana dava konusu ta\u015f\u0131nmazdaki fuzuli i\u015fgaline son verilmesi i\u00e7in daval\u0131ya ihtaratta bulunduklar\u0131n\u0131, tan\u0131k beyanlar\u0131 ile ispat edeceklerini bildirerek fazlaya ili\u015fkin talepleri sakl\u0131 kalmak kayd\u0131 ile toplam 20.000,00-TL ecrimisilin d\u00f6nem sonlar\u0131ndan itibaren hesaplanacak olan ticari avans faizi ile birlikte daval\u0131dan tahsiline karar verilmesini talep ve dava etmi\u015ftir.<\/p>\n<p>Daval\u0131 \u015firket vekili cevap dilek\u00e7esinde \u00f6zetle: davac\u0131 taraf\u0131ndan ihtarnamede 215.015,71-TL, dava a\u00e7\u0131l\u0131rken 20.000,00-TL ecrimisil talep edildi\u011finden ihtarnamede belirtilen ecrimisil tutar\u0131 \u00fczerinden harc\u0131n ikmal edilmesi gerekti\u011fini, taraflar aras\u0131ndaki kira ili\u015fkisinin 01.12.2001 tarihli s\u00f6zle\u015fme ile ba\u015flad\u0131\u011f\u0131n\u0131, davaya konu edilen b\u00f6l\u00fcm\u00fcn, kira kontrat\u0131na konu olan d\u00fckk\u00e2n\u0131n m\u00fctemmim c\u00fcz&#8217;\u00fc niteli\u011finde, banka \u015fubesi giri\u015fi d\u0131\u015f\u0131nda ayr\u0131 bir giri\u015fi dahi olmayan ve tapu kayd\u0131nda da ba\u011f\u0131ms\u0131z b\u00f6l\u00fcm olarak kay\u0131tl\u0131 olmayan bir b\u00f6l\u00fcm oldu\u011fundan ayr\u0131ca kira veya sair gelir elde edilebilecek vas\u0131fta olmad\u0131\u011f\u0131n\u0131 bildirerek davan\u0131n reddine karar verilmesini. davan\u0131n reddine karar verilmesini talep etmi\u015ftir.<\/p>\n<p>Mahkemece yap\u0131lan yarg\u0131lama sonucunda;&#8230;3.Asliye Hukuk Mahkemesinin 22.02.2011 tarih,2010\/104 Esas,2011\/37 Karar say\u0131l\u0131 karar\u0131 ile;davan\u0131n reddine karar verilmi\u015ftir.<\/p>\n<p>Davac\u0131 vekilinin temyizi \u00fczerine Y\u00fcksek 3.HD. 29.11.2011 g\u00fcn ve 10877\/19020 E\/K say\u0131l\u0131 karar\u0131 ile \u201cDavac\u0131 vekili dilek\u00e7esi ile; m\u00fcvekkillerine ait ta\u015f\u0131nmaz\u0131n, 01.12.2001 ba\u015flang\u0131\u00e7 tarihli kira s\u00f6zle\u015fmesi ile daval\u0131ya kiraland\u0131\u011f\u0131n\u0131; kira s\u00f6zle\u015fmesi gere\u011fince, ta\u015f\u0131nmaz\u0131n zemin kat 1 nolu asma katl\u0131 d\u00fckkan ve 1.katta bulunan 2, 3, 4, 5, 6 ve 7 nolu b\u00fcro vas\u0131fl\u0131 ba\u011f\u0131ms\u0131z b\u00f6l\u00fcmlerinin kiralanm\u0131\u015f bulundu\u011funu; daval\u0131 banka \u015fubesinin, kira s\u00f6zle\u015fmesine dahil edilmeyen bodrum kat\u0131 da kiralam\u0131\u015f oldu\u011fu alanlar ile birle\u015ftirerek kullanmaya ba\u015flad\u0131\u011f\u0131n\u0131, bu kullan\u0131ma r\u0131zalar\u0131n\u0131n olmad\u0131\u011f\u0131n\u0131 daval\u0131 tarafa defalarca ihtaratta bulunduklar\u0131n\u0131, buna ra\u011fmen daval\u0131n\u0131n kullan\u0131m\u0131n\u0131 s\u00fcrd\u00fcrd\u00fc\u011f\u00fcn\u00fc iddia ederek; davan\u0131n reddini istemi\u015ftir.Mahkemece; \u201cDava konusu ta\u015f\u0131nmaz\u0131n davac\u0131lar ad\u0131na kay\u0131tl\u0131 olup, kat irtifakl\u0131 ta\u015f\u0131nmazda davac\u0131lar\u0131n 1\/2\u2019\u015fer hisselerinin bulundu\u011fu, taraflar aras\u0131nda tanzim edilen 01.02.2001 ba\u015flang\u0131\u00e7 tarihli kira s\u00f6zle\u015fmesi ile ta\u015f\u0131nmaz\u0131n zemin kat 1 nolu asma katl\u0131 d\u00fckkan ve 1.katta bulunan 2, 3, 4, 5, 6 ve 7 nolu b\u00fcro vas\u0131fl\u0131 ba\u011f\u0131ms\u0131z b\u00f6l\u00fcmlerin davac\u0131lar taraf\u0131ndan daval\u0131 bankaya 10 y\u0131ll\u0131\u011f\u0131na kiraya verildi\u011fi, mahkememizce mahallinde yap\u0131lan ke\u015fifte ecrimisil talep edilen davaya konu b\u00f6l\u00fcm\u00fcn bodrum kat olup projede s\u0131\u011f\u0131nak olarak yer alan ortak kullan\u0131m alan\u0131nda kald\u0131\u011f\u0131, d\u0131\u015far\u0131ya \u00e7\u0131k\u0131\u015f kap\u0131s\u0131n\u0131n bulunmad\u0131\u011f\u0131, kiraya verilme ve gelir sa\u011flama olana\u011f\u0131 bulunan yerlerden olmad\u0131\u011f\u0131 anla\u015f\u0131ld\u0131\u011f\u0131ndan ecrimisil talep edilmesi m\u00fcmk\u00fcn g\u00f6r\u00fclmemekle, davan\u0131n reddine karar verilmesi gerekmi\u015ftir.<\/p>\n<p>Gerek\u00e7esiyle\u201d davan\u0131n reddi cihetine gidilmi\u015f, h\u00fck\u00fcm davac\u0131lar vekili taraf\u0131ndan s\u00fcresinde temyiz edilmi\u015ftir. Davac\u0131lar, malik olduklar\u0131 binan\u0131n bodrum kat\u0131n\u0131n daval\u0131 taraf\u0131ndan kira s\u00f6zle\u015fmesi kapsam\u0131 d\u0131\u015f\u0131nda kullan\u0131ld\u0131\u011f\u0131n\u0131, kar\u015f\u0131l\u0131\u011f\u0131nda bir \u00fccret \u00f6denmedi\u011fini iddia ederek; haks\u0131z kullan\u0131m kar\u015f\u0131l\u0131\u011f\u0131, ecrimisil talep etmektedirler.Bilindi\u011fi gibi, gerek \u00f6\u011fretide ve gerekse yarg\u0131sal uygulamalarda ifade edildi\u011fi \u00fczere, ecrimisil; (di\u011fer bir deyi\u015fle i\u015fgal tazminat\u0131) hak sahibinin k\u00f6t\u00fcniyetli zilyetten isteyebilece\u011fi bir tazminat olup, 08.03.1950 tarih 22\/4 say\u0131l\u0131 \u0130nan\u00e7lar\u0131 Birle\u015ftirme Karar\u0131nda \u201c&#8230;fuzuli i\u015fgalin kiraya benzetilemeyece\u011fi, haks\u0131z bir eylem say\u0131lmas\u0131 gerekti\u011fi&#8230;.bir zarar meydana gelirse bunun tazmin ettirilece\u011fi,&#8230;Medeni Kanunun (eski) 908.maddesi anlam\u0131nda zilyedin faydalanmas\u0131ndan do\u011fan bir istem oldu\u011fu&#8230;\u201d vurgulanm\u0131\u015ft\u0131r. Ecrimisil, haks\u0131z i\u015fgal nedeniyle tazminat olarak nitelendirilen \u00f6zel bir zarar giderim bi\u00e7imi olmas\u0131 nedeniyle, en az\u0131 kira geliri, en \u00e7o\u011fu ise tam gelir yoksunlu\u011fu kar\u015f\u0131l\u0131\u011f\u0131 zarard\u0131r.Somut olayda; daval\u0131n\u0131n, kiralad\u0131\u011f\u0131 zemin kattaki asma katl\u0131 d\u00fckk\u00e2n\u0131, (bina projesinde ba\u011f\u0131ms\u0131z b\u00f6l\u00fcm olarak g\u00f6sterilmeyen) bodrum katla ili\u015fkilendirerek (ekonomik fayda sa\u011flamak amac\u0131yla) birlikte kulland\u0131\u011f\u0131; buna kar\u015f\u0131l\u0131k, davac\u0131lar\u0131n bu kullan\u0131m nedeniyle bir zarar\u0131n\u0131n do\u011fdu\u011fu anla\u015f\u0131lmaktad\u0131r. Mahkemece, daval\u0131 taraf\u0131ndan yararlan\u0131lan ve haks\u0131z olarak kullan\u0131lan bu yerin, bodrum kat olup projede s\u0131\u011f\u0131nak olarak yer alan ortak kullan\u0131m alan\u0131nda kald\u0131\u011f\u0131, d\u0131\u015far\u0131ya \u00e7\u0131k\u0131\u015f kap\u0131s\u0131n\u0131n bulunmad\u0131\u011f\u0131, kiraya verilme ve gelir sa\u011flama olana\u011f\u0131 bulunan yerlerden olmad\u0131\u011f\u0131ndan bahisle, ecrimisil talebinin reddine karar verilmi\u015ftir. Oysa, bir kimsenin ba\u015fkas\u0131na ait oldu\u011funu bildi\u011fi ta\u015f\u0131nmaz\u0131; hukuki bir dayana\u011f\u0131 olmadan kendi mal\u0131 gibi kullanmas\u0131 ve dolay\u0131s\u0131yla ekonomik yarar sa\u011flamas\u0131n\u0131n bir kar\u015f\u0131l\u0131\u011f\u0131 olmal\u0131d\u0131r. Bir nesneye (ta\u015f\u0131nmaza) haks\u0131z olarak k\u00f6t\u00fcniyetle, kendi \u00e7\u0131kar\u0131na zilyet olan kimse, onu hak sahibine geri vermekle y\u00fck\u00fcml\u00fcd\u00fcr.Bundan ayr\u0131 olarak, kendi \u00e7\u0131kar\u0131na haks\u0131z olarak ba\u015fkas\u0131n\u0131n hukuk alan\u0131na girip, i\u015fine kar\u0131\u015f\u0131p kazan\u00e7 elde eden kimse (daval\u0131), hak sahibinin (davac\u0131n\u0131n) tazminat davas\u0131ndaki gibi zarar\u0131 ya da nedensiz zenginle\u015fmedeki gibi yoksulla\u015fmas\u0131 aranmaks\u0131z\u0131n &#8211; Bu \u201chaks\u0131z kar\u0131\u015fma kazanc\u0131\u201dn\u0131 geri vermesi gerekmektedir (Tando\u011fan, Haluk:Mukayeseli Hukuk ve Hususiyle \u0130svi\u00e7re-T\u00fcrk Hukuku bak\u0131m\u0131ndan Vekaletsiz \u0130\u015fg\u00f6rme, \u0130st.1957, sh, 56 vd; 60\/61, 64\/66 da an\u0131lan yazarlar. Dava konusu ta\u015f\u0131nmaz\u0131n davac\u0131lar ad\u0131na kay\u0131tl\u0131 olup, kat irtifakl\u0131 ta\u015f\u0131nmazda davac\u0131lar\u0131n 1\/2&#8217;\u015fer hisselerinin bulundu\u011fu, taraflar aras\u0131nda tanzim edilen 01.02.2001 ba\u015flang\u0131\u00e7 tarihli kira s\u00f6zle\u015fmesi ile ta\u015f\u0131nmaz\u0131n zemin kat 1 nolu asma katl\u0131 d\u00fckk\u00e2n ve 1.katta bulunan 2, 3, 4, 5, 6 ve 7 nolu b\u00fcro vas\u0131fl\u0131 ba\u011f\u0131ms\u0131z b\u00f6l\u00fcmlerin davac\u0131lar taraf\u0131ndan daval\u0131 bankaya 10 y\u0131ll\u0131\u011f\u0131na kiraya verildi\u011fi, mahkememizce mahallinde yap\u0131lan ke\u015fifte ecrimisil talep edilen davaya konu b\u00f6l\u00fcm\u00fcn bodrum kat olup projede s\u0131\u011f\u0131nak olarak yer alan ortak kullan\u0131m alan\u0131nda kald\u0131\u011f\u0131, d\u0131\u015far\u0131ya \u00e7\u0131k\u0131\u015f kap\u0131s\u0131n\u0131n bulunmad\u0131\u011f\u0131, kiraya verilme ve gelir sa\u011flama olana\u011f\u0131 bulunan yerlerden olmad\u0131\u011f\u0131, ayr\u0131 ba\u011f\u0131ms\u0131z b\u00f6l\u00fcm niteli\u011finde olmad\u0131\u011f\u0131 anla\u015f\u0131ld\u0131\u011f\u0131ndan ecrimisil talep edilmesi m\u00fcmk\u00fcn g\u00f6r\u00fclmemekle mahkememizce verilen 2010\/104 esas, 22.02.2011 tarih ve 2011\/37 say\u0131l\u0131 h\u00fck\u00fcmde direnilmesine, bu nedenle davan\u0131n reddine karar verilmesi gerekmi\u015ftir.\u201d gerek\u00e7esi ile ,direnme karar\u0131 verilmi\u015f,direnme karar\u0131 davac\u0131 vekilince temyiz edilmi\u015f, Y\u00fcksek Hukuk Genel Kurulunun say\u0131n \u00e7o\u011funlu\u011funun g\u00f6r\u00fc\u015fleri do\u011frultusunda direnme karar\u0131 bozulmu\u015ftur.<\/p>\n<p>A\u015fa\u011f\u0131daki nedenlerle say\u0131n \u00e7o\u011funlu\u011fun bozma y\u00f6n\u00fcndeki g\u00f6r\u00fc\u015flerine kat\u0131lm\u0131yoruz.<\/p>\n<p>Taraflar aras\u0131ndaki uyu\u015fmazl\u0131\u011f\u0131n, davac\u0131 kiralayanlar taraf\u0131ndan, daval\u0131 kirac\u0131ya, kiralanan ta\u015f\u0131nmazda s\u0131\u011f\u0131nak olarak ge\u00e7en yerin, daval\u0131 kirac\u0131 taraf\u0131ndan amac\u0131 d\u0131\u015f\u0131nda kullan\u0131lmas\u0131 nedeniyle ecrimisil \u00f6denip \u00f6denmeyece\u011fi noktas\u0131nda topland\u0131\u011f\u0131 anla\u015f\u0131lmaktad\u0131r.Ta\u015f\u0131nmaz\u0131n, davac\u0131lar taraf\u0131ndan daval\u0131 bankaya kiraland\u0131\u011f\u0131,projede s\u0131\u011f\u0131nak olarak belirlenen yerin daval\u0131 taraf\u0131ndan kullan\u0131ld\u0131\u011f\u0131 konular\u0131nda bir \u00e7eki\u015fme mevcut de\u011fildir.Esasen uyu\u015fmazl\u0131k; s\u0131\u011f\u0131naklar\u0131n ama\u00e7 d\u0131\u015f\u0131 kullan\u0131lmas\u0131n\u0131n haks\u0131z kullan\u0131m say\u0131l\u0131p say\u0131lmayaca\u011f\u0131 ve bu kullan\u0131mdan dolay\u0131 ecrimisil istenip istenmeyece\u011fi noktas\u0131nda toplanmaktad\u0131r.<\/p>\n<p>Yerel mahkemece;davac\u0131lar\u0131n ecrimisil talepleri, projede s\u0131\u011f\u0131nak olarak yer alan bu alan\u0131n daval\u0131 kirac\u0131 taraf\u0131ndan kullan\u0131ld\u0131\u011f\u0131 tespit edilmi\u015f olmas\u0131na ra\u011fmen ,bu yerlerin kiraya verilme ve kira geliri getirme \u00f6zelli\u011finin bulunmad\u0131\u011f\u0131 gerek\u00e7esi ile talep reddedilmi\u015ftir.<\/p>\n<p>Y\u00fcksek \u00d6zel Dairece; ecrimisilin hak sahibinin k\u00f6t\u00fcniyetli zilyetten isteyebilece\u011fi bir tazminat t\u00fcr\u00fc oldu\u011fu, kulan\u0131mdan dolay\u0131 bir zarar do\u011fdu\u011fu,daval\u0131 kirac\u0131n\u0131n ekonomik \u00e7\u0131kar elde etti\u011fi ve kullan\u0131lan yerin s\u0131\u011f\u0131nak olmas\u0131n\u0131n, ecrimisilin verilmesi a\u00e7\u0131s\u0131ndan \u00f6nemli olmad\u0131\u011f\u0131 gerek\u00e7eleri ile karar\u0131n bozulmas\u0131na karar verilmi\u015ftir.<\/p>\n<p>Daval\u0131 kirac\u0131 taraf\u0131ndan, kira s\u00f6zle\u015fmesine istinaden kullan\u0131lan ta\u015f\u0131nmaz\u0131n bodrumunda yer alan ve projede s\u0131\u011f\u0131nak yeri olarak g\u00f6z\u00fcken yeri kullanmas\u0131, haks\u0131z kullan\u0131m olarak de\u011ferlendirilebilir ise de;s\u0131\u011f\u0131naklar, Kat M\u00fclkiyeti Kanununa g\u00f6re ortak yerlerden olup,bir ki\u015finin Ya da ki\u015filerin kullan\u0131m\u0131na tahsis edilmesi m\u00fcmk\u00fcn de\u011fildir.Ola\u011fan\u00fcst\u00fc hallerde, t\u00fcm kat maliklerince, amac\u0131na uygun kullan\u0131lmas\u0131 gereken yerin, amac\u0131 d\u0131\u015f\u0131nda kullan\u0131lmas\u0131 ve bu kullan\u0131mdan ta\u015f\u0131nmaz maliki yarar\u0131na hak do\u011fmas\u0131 hukuk d\u00fczeni a\u00e7\u0131s\u0131ndan m\u00fcmk\u00fcn de\u011fildir.Hukuk d\u00fczeninin korumad\u0131\u011f\u0131 bir durumdan, yasal olarak hak \u00e7\u0131kar\u0131m\u0131 yap\u0131lamaz.Hukuk d\u00fczeni bir taraftan s\u0131\u011f\u0131naklar\u0131n \u00f6zel ki\u015filer taraf\u0131ndan kullan\u0131lmas\u0131n\u0131 yasaklarken, di\u011fer yandan,kullan\u0131m\u0131 yasak olan bir yerin malikinin ecrimisil ad\u0131 alt\u0131nda bir kazan\u0131mda bulunmas\u0131na cevaz vermez.Aksi d\u00fc\u015f\u00fcnce;hukuk d\u00fczeni a\u00e7\u0131s\u0131ndan ciddi bir \u00e7eli\u015fki yarat\u0131r.Hukuk d\u00fczeninin korumad\u0131\u011f\u0131 bir de\u011ferden, bir taraf yarar\u0131na hak \u00e7\u0131kar\u0131lmas\u0131 m\u00fcmk\u00fcn de\u011fildir.<\/p>\n<p>Somut olayda s\u0131\u011f\u0131na\u011f\u0131n yer ald\u0131\u011f\u0131 ta\u015f\u0131nmaz, davac\u0131 malikler taraf\u0131ndan daval\u0131 bankaya 01.12.2001 tarihinde kiraya verilmi\u015f ve kira aktinin devam etti\u011fi anla\u015f\u0131lmaktad\u0131r.Davac\u0131lar, bu kullan\u0131mdan yakla\u015f\u0131k 9 y\u0131l ge\u00e7tikten sonra 25.02.2010 tarihli noter ihtarnamesi ile ecrimisil talebinde bulunmu\u015flard\u0131r.Bu davran\u0131\u015f, iyiniyet kurallar\u0131 ile de ba\u011fda\u015fmaz.Herkes, haklar\u0131n\u0131 kullan\u0131rken ve bor\u00e7lar\u0131n\u0131 ifa ederken, iyiniyet kurallar\u0131na uymakla y\u00fck\u00fcml\u00fcd\u00fcr. 9 y\u0131l\u0131 a\u015fk\u0131n kullan\u0131m amac\u0131na uygun olmayacak \u015fekilde s\u0131\u011f\u0131na\u011f\u0131n kullan\u0131lmas\u0131na g\u00f6z yumulup, 9 y\u0131l ge\u00e7tikten sonra, ecrimisil istemek yerine, davac\u0131lar\u0131n,daval\u0131 kirac\u0131y\u0131, haks\u0131z kullan\u0131m\u0131 g\u00f6rd\u00fc\u011f\u00fc anda, (s\u0131\u011f\u0131na\u011f\u0131n, ortak yerlerden oldu\u011fu,bu yerlerin amac\u0131 d\u0131\u015f\u0131nda kullan\u0131lmas\u0131n\u0131n akte ayk\u0131r\u0131l\u0131k te\u015fkil etti\u011fi \u015feklinde) uyarmak ve gerekti\u011finde akte ayk\u0131r\u0131l\u0131k sebebine dayal\u0131 tahliye davas\u0131 a\u00e7mak ve s\u0131\u011f\u0131na\u011f\u0131n ger\u00e7ek amac\u0131na uygun kullan\u0131m\u0131n\u0131 sa\u011flamak olmal\u0131yd\u0131.Bozma karar\u0131na zorunlu olarak uyacak mahkemenin ecrimisil karar\u0131ndan sonra, ecrimisil \u00f6denecek, taraflarda, s\u0131\u011f\u0131na\u011f\u0131n, ecrimisil bedelini \u00f6demek kayd\u0131yla kullan\u0131m\u0131n\u0131n yasal hale geldi\u011fi inanc\u0131 olu\u015facakt\u0131r. Bu surette, daval\u0131 kirac\u0131n\u0131n, davac\u0131lara ecrimisil bedelini \u00f6demek suretiyle s\u0131\u011f\u0131na\u011f\u0131 amac\u0131 d\u0131\u015f\u0131nda kullanmaya devam edecek olmas\u0131 son derece yanl\u0131\u015f uygulamalar\u0131 beraberinde getirecek,belki de s\u0131\u011f\u0131na\u011f\u0131n amac\u0131 d\u0131\u015f\u0131nda kullan\u0131m\u0131 nedeniyle olu\u015facak bir ola\u011fan\u00fcst\u00fc durum kar\u015f\u0131s\u0131nda kiralanan da \u00e7al\u0131\u015fanlar\u0131n hayat\u00ee bir tehlikeyle kar\u015f\u0131la\u015fmas\u0131 muhtemel olacakt\u0131r.<\/p>\n<p>Kat M\u00fclkiyeti h\u00fck\u00fcmleri gere\u011fince tamamen kamu yarar\u0131 d\u00fc\u015f\u00fcncesi ile ortak yerlerden olarak projede belirlenen,t\u00fcm kat maliklerinin onay\u0131 ile dahi kiraya verilmesi ve kullan\u0131m amac\u0131 de\u011fi\u015ftirilmesi m\u00fcmk\u00fcn olmayan s\u0131\u011f\u0131na\u011f\u0131n, kullan\u0131m amac\u0131 d\u0131\u015f\u0131nda kullan\u0131lmas\u0131 halinde kat maliklerinin bu kullan\u0131mdan dolay\u0131 ecrimisil isteyemeyece\u011fi y\u00f6n\u00fcndeki yerel mahkeme karar\u0131 isabetlidir.<\/p>\n<p>T\u00fcm bu nedenlerle; yerel mahkeme karar\u0131n\u0131n onanmas\u0131 gerekti\u011finden, say\u0131n \u00e7o\u011funlu\u011fun yerel mahkeme karar\u0131n\u0131n bozulmas\u0131 y\u00f6n\u00fcndeki g\u00f6r\u00fc\u015flerine kat\u0131lm\u0131yoruz.<\/p>\n<p>15.Hukuk Dairesi Ba\u015fkan\u0131 15.Hukuk Dairesi \u00dcyesi<\/p>\n<p><span style=\"color: #800000;\"><em>KAR\u015eI OY YAZISI<\/em><\/span><\/p>\n<p>Uyu\u015fmazl\u0131k, kat irtifak\u0131 kurulu olan bir ta\u015f\u0131nmazda, ortak yer niteli\u011findeki s\u0131\u011f\u0131na\u011f\u0131n kirac\u0131 taraf\u0131ndan kullan\u0131lmas\u0131 nedeniyle ecrimisil \u00f6denmesi gerekip gerekmedi\u011fi noktas\u0131ndad\u0131r.<\/p>\n<p>Kat maliki olan davac\u0131lar ile daval\u0131 aras\u0131nda 01.02.2001 ba\u015flang\u0131\u00e7 tarihli ve 10 y\u0131l s\u00fcreli kira s\u00f6zle\u015fmesi d\u00fczenlenmi\u015ftir. S\u00f6zle\u015fmeyle zemin kattaki 1 nolu ba\u011f\u0131ms\u0131z b\u00f6l\u00fcm ile zemin \u00fcst\u00fcndeki alt\u0131 adet ba\u011f\u0131ms\u0131z b\u00f6l\u00fcm i\u015f yeri olarak kiralanm\u0131\u015ft\u0131r.<\/p>\n<p>Zemin kattaki 1 nolu ba\u011f\u0131ms\u0131z b\u00f6l\u00fcm, bodrum kattaki s\u0131\u011f\u0131nak ile irtibatl\u0131 olup, kirac\u0131 buras\u0131n\u0131 kira s\u00f6zle\u015fmesinin ba\u015f\u0131ndan beri ar\u015fiv odas\u0131, mutfak ve yemekhane olarak kullanmaktad\u0131r. Kiraya verenler aradan 8 y\u0131l 2 ay 24 g\u00fcn gibi uzunca bir s\u00fcre ge\u00e7tikten sonra \u00e7ektikleri noter ihtarnamesi ile kirac\u0131dan ecrimisil istemi\u015fler, akabinde i\u015f bu davay\u0131 a\u00e7m\u0131\u015flard\u0131r. Dava konusu yer onayl\u0131 projesine g\u00f6re s\u0131\u011f\u0131nak niteli\u011finde ortak yer olarak tahsis edildi\u011finden, uyu\u015fmazl\u0131\u011f\u0131n hakl\u0131 bir \u00e7\u00f6z\u00fcme kavu\u015fabilmesi i\u00e7in, kira s\u00f6zle\u015fmesi h\u00fck\u00fcmleri (genel h\u00fck\u00fcmler) ile Kat M\u00fclkiyeti Kanunu h\u00fck\u00fcmlerinin birlikte de\u011ferlendirilmesi gerekmektedir.<\/p>\n<p>Kiraya konu edilen zemin kattaki 1 nolu ba\u011f\u0131ms\u0131z b\u00f6l\u00fcm\u00fcn, davaya konu bodrum kattaki s\u0131\u011f\u0131nakla do\u011frudan irtibatl\u0131 oldu\u011fu, zemin kat\u0131n kirac\u0131ya teslimiyle birlikte bodrum kattaki s\u0131\u011f\u0131na\u011f\u0131n zilyetli\u011finin kirac\u0131ya ge\u00e7ti\u011fi ve s\u00f6zle\u015fmenin ba\u015flang\u0131c\u0131ndan beri kirac\u0131n\u0131n zilyet ve tasarrufunda oldu\u011funda uyu\u015fmazl\u0131k yoktur. Kiraya verenler de bu duruma 8 y\u0131l 2 ay 24 g\u00fcn gibi uzunca bir s\u00fcre ses \u00e7\u0131karmam\u0131\u015flard\u0131r.<\/p>\n<p>Ecrimisil, hak sahibinin k\u00f6t\u00fc niyetli zilyetten isteyebilece\u011fi bir tazminat oldu\u011funa g\u00f6re, b\u00f6ylesi bir durumda kirac\u0131n\u0131n k\u00f6t\u00fc niyetli zilyet oldu\u011fu ileri s\u00fcr\u00fclebilir mi? Bu soruya olumlu cevap vermek m\u00fcmk\u00fcn g\u00f6r\u00fclmemektedir.<\/p>\n<p>\u00d6te yandan, 634 say\u0131l\u0131 Kat M\u00fclkiyeti Kanunu 4\/a maddesiyle, s\u0131\u011f\u0131naklar ortak yerler aras\u0131nda say\u0131lm\u0131\u015ft\u0131r. Ayn\u0131 kanunun 6\/4.maddesinde de, ba\u011f\u0131ms\u0131z b\u00f6l\u00fcmlerin ba\u015fkas\u0131na devri, kay\u0131tlanmas\u0131 veya kiralanmas\u0131 halinde eklentiler ve ortak yerler de kendili\u011finden devredilmi\u015f, kay\u0131tlanm\u0131\u015f veya kiralanm\u0131\u015f olur, h\u00fckm\u00fc \u00f6ng\u00f6r\u00fclm\u00fc\u015ft\u00fcr. Kira s\u00f6zle\u015fmesi bu kanun h\u00fckm\u00fcyle birlikte de\u011ferlendirildi\u011fi takdirde de, kirac\u0131n\u0131n somut olay a\u00e7\u0131s\u0131ndan k\u00f6t\u00fc niyetli zilyet olarak kabul\u00fcn\u00fcn m\u00fcmk\u00fcn olmad\u0131\u011f\u0131 sonucuna var\u0131lmaktad\u0131r.<\/p>\n<p>Yine Kat M\u00fclkiyeti Kanunu 45.maddesine g\u00f6re, ana yap\u0131n\u0131n d\u0131\u015f duvarlar\u0131n\u0131n, \u00e7at\u0131 veya dam\u0131n\u0131n reklam maksad\u0131 ile kiralanmas\u0131 gibi \u00f6nemli y\u00f6netim i\u015fleri, b\u00fct\u00fcn kat maliklerinin oy birli\u011fi ile verecekleri karar ile m\u00fcmk\u00fcn ise de;<\/p>\n<p>\u00d6zel ortak ama\u00e7lara tahsis edilmi\u015f ortak yerlerin, bu \u00f6zel amaca tahsisi kald\u0131r\u0131lmad\u0131\u011f\u0131 m\u00fcddet\u00e7e, her hangi bir gelir getirmesi ve t\u00fcm kat maliklerinin oy birli\u011fi ile karar almas\u0131 halinde dahi kiraya verilmesi m\u00fcmk\u00fcn olmad\u0131\u011f\u0131ndan, bu gibi yerlerin i\u015fgali sebebiyle de ecrimisil istenemez.\u00a0\u00a0\u00a0\u00a0<em> (Yarg\u0131tay 18.H.D.&#8217;nin 11.12.2006 tarih ve 2006\/7513-10438 say\u0131l\u0131 ictihad\u0131)<\/em><\/p>\n<p>Bu nedenlerle, somut olayda davaya konu edilen s\u0131\u011f\u0131nak da \u00f6zel amaca tahsisli bu ortak yerlerden say\u0131ld\u0131\u011f\u0131ndan, yerel mahkemenin ecrimisil istenemeyece\u011fine dair direnme karar\u0131 usul ve yasaya uygun olup, onanmas\u0131 gerekirken, bozulmas\u0131na dair say\u0131n \u00e7o\u011funlu\u011fun de\u011ferli g\u00f6r\u00fc\u015f\u00fcne kat\u0131lam\u0131yorum.<br \/>\n18.Hukuk Dairesi Ba\u015fkan\u0131<\/p>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<footer id=\"footer\">\n<div class=\"row copyright\"><\/div>\n<\/footer>\n","protected":false},"excerpt":{"rendered":"<p>Ecrimisil, di\u011fer bir ifade ile i\u015fgal\u00a0tazminat\u0131, bir mal\u0131n sahibinin ya da idarenin izni d\u0131\u015f\u0131nda kullan\u0131lmas\u0131na verilen isimdir.
