Bu fesihte, ihbar ve k\u0131dem tazminat\u0131 \u00f6denmez.<\/p>\n<p style=\"text-align: justify;\"><strong><span style=\"color: #333399;\">S.2 \u0130\u015f\u00e7inin ikinci bir i\u015fte \u00e7al\u0131\u015fmaya ba\u015flamas\u0131 i\u015fveren taraf\u0131ndan derhal fesih hakk\u0131 do\u011furur mu?<\/span><\/strong><\/p>\n<p style=\"text-align: justify;\">\u0130\u015f\u00e7inin, i\u015fveren ile bu hareketini yasaklayan yaz\u0131l\u0131 veya s\u00f6zl\u00fc bir anla\u015fma yok ise i\u015f\u00e7i birden fazla i\u015fverenle \u00e7al\u0131\u015fabilir. Mevzuat\u0131m\u0131zda bu \u015fekilde \u00e7al\u0131\u015fmay\u0131 engelleyen h\u00fck\u00fcm yoktur. Ancak i\u015fveren s\u00f6zle\u015fmeye yaz\u0131l\u0131 izin al\u0131nmaks\u0131z\u0131n herhangi bir i\u015fyerinde veya yapmakta oldu\u011fu i\u015fin benzeri i\u015fyerlerinde \u00e7al\u0131\u015fmay\u0131 yasaklam\u0131\u015f olmas\u0131 halinde bu s\u00f6zle\u015fmeyi imzalayan i\u015f\u00e7i buna uymamakla y\u00fck\u00fcml\u00fcd\u00fcr. Aksi halde i\u015fverenin g\u00fcvenini ve iyi niyetini k\u00f6t\u00fcye kullanm\u0131\u015f olmakla derhal fesih hakk\u0131 do\u011fmu\u015f olur.<\/p>\n<p style=\"text-align: justify;\"><strong><span style=\"color: #333399;\">S.3 \u0130\u015f Kanunu a\u00e7\u0131s\u0131ndan \u0130\u015fveren Vekili kimdir?<\/span><\/strong><\/p>\n<p style=\"text-align: justify;\">\u0130\u015fveren vekili \u0130\u015f Kanunun 2. maddesinde \u201c\u0130\u015fveren ad\u0131na hareket eden ve i\u015fin, i\u015fyerinin ve i\u015fletmenin y\u00f6netiminde g\u00f6rev alan kimselere i\u015fveren vekili denir\u201d \u015feklinde tan\u0131mlanm\u0131\u015ft\u0131r. Bu tan\u0131ma g\u00f6re i\u015fveren vekili i\u015fyerinde \u00e7al\u0131\u015fan m\u00fcd\u00fcr, \u015fef, ustaba\u015f\u0131, amir s\u0131fat\u0131yla \u00e7al\u0131\u015fan t\u00fcm y\u00f6neticileri kapsar.<\/p>\n<p style=\"text-align: justify;\">\u0130\u015fveren vekili i\u015f\u00e7ilere her t\u00fcrl\u00fc emir ve talimat\u0131 vermeye yetkili oldu\u011fu gibi imzalad\u0131\u011f\u0131 t\u00fcm belge ve yaz\u0131lardan da i\u015fletme sorumludur.<\/p>\n<p style=\"text-align: justify;\">\u0130\u015f\u00e7iye verilen izin k\u00e2\u011f\u0131d\u0131, maa\u015f bordrosu, k\u0131demini g\u00f6sterir yaz\u0131 ve s\u00f6zle\u015fmeler i\u015fveren vekilleri taraf\u0131ndan imzaland\u0131\u011f\u0131nda ge\u00e7erlidir ve i\u015fletmeyi ba\u011flar. O nedenle banka veya konsolosluklara veya resmi di\u011fer kurumlara verilen \u00fccret yaz\u0131lar\u0131nda i\u015fveren vekilleri de do\u011frulu\u011fa dikkat etmek zorundad\u0131r.<\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #333399;\"><strong>S.4 \u0130\u015fveren olarak hangi durumlarda savunma almal\u0131 ve tutanak tutmal\u0131y\u0131z<\/strong>.<\/span><\/p>\n<p style=\"text-align: justify;\">\u0130\u015fveren yasalar kar\u015f\u0131s\u0131nda ispat y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fcne sahiptir. Bu nedenle her olayda ve i\u015flemde ilgili m\u00fcfetti\u015f ve mahkemelerce belgelere bak\u0131laca\u011f\u0131 inanc\u0131yla hareket etmelidir.<\/p>\n<ul style=\"text-align: justify;\">\n<li>Maa\u015f bordrolar\u0131<\/li>\n<li>\u0130zin i\u015flemleri (\u00dccretli Y\u0131ll\u0131k \u0130zin, Mazeret \u0130zni, \u0130dari \u0130zin, \u00dccretsiz \u0130zin vs)<\/li>\n<li>\u0130\u015f Kazas\u0131 bildirimi<\/li>\n<li>SGK i\u015f\u00e7i giri\u015f bildirimi veya \u0130AB i\u015f\u00e7i \u00e7\u0131k\u0131\u015f bildirimi,<\/li>\n<\/ul>\n<p style=\"text-align: justify;\">Gibi i\u015flemler mutlaka matbu evraklarla yap\u0131lmal\u0131 ve saklanmal\u0131d\u0131r:<\/p>\n<p style=\"text-align: justify;\">A\u015fa\u011f\u0131daki durumlarda ise i\u015f\u00e7inin savunmas\u0131 al\u0131nmal\u0131 ve tutanak tutulmal\u0131d\u0131r.<\/p>\n<ul style=\"text-align: justify;\">\n<li>Tart\u0131\u015fma, hakaret, s\u00f6zl\u00fc veya fiili sata\u015fma (i\u015f arkada\u015flar\u0131, i\u015fveren veya vekili, m\u00fc\u015fteriler vs.)<\/li>\n<li>\u0130\u015f yerinden izinsiz ayr\u0131lma veya ge\u00e7 gelme<\/li>\n<li>\u0130\u015fe gelmeme<\/li>\n<li>\u0130\u015fverene zarar verme<\/li>\n<li>\u0130\u015f sa\u011fl\u0131\u011f\u0131 ve g\u00fcvenli\u011fi \u00f6nlemlerine uymama<\/li>\n<li>\u0130\u015fini zaman\u0131nda yapmama, emirlere uymama, i\u015fi aksatma<\/li>\n<\/ul>\n<p style=\"text-align: justify;\">Tutanak olayda i\u015f\u00e7inin halini veya i\u015fe gelmeyi\u015fini vs. anlatan \u015fahitler ifadesidir. Birim amirinin notlar\u0131 ve alt\u0131ndaki imzas\u0131 durumu belgelemeye yetmez. Bir aksakl\u0131k veya olay\u0131n anlat\u0131m\u0131nda en az bir i\u015f\u00e7inin \u015fahit olarak imzas\u0131 al\u0131nmal\u0131d\u0131r. \u0130\u015fe gelmeme veya ge\u00e7 gelme durumlar\u0131nda tutanak alt\u0131na puantaj kay\u0131tlar\u0131n\u0131n konulmas\u0131 da yeterli olacakt\u0131r.<\/p>\n<p style=\"text-align: justify;\">Savunma ise i\u015f\u00e7inin yap\u0131lan bu hareket sonras\u0131nda yaz\u0131l\u0131 cevab\u0131n\u0131 istemektir. Bu hakk\u0131 i\u015f\u00e7iye vermeyen i\u015fveren hakl\u0131 bile olsa usulde hata yapm\u0131\u015f olaca\u011f\u0131ndan sorun ya\u015fayabilecektir. \u0130\u015f K. 19. maddeye g\u00f6re savunmas\u0131 al\u0131nmadan i\u015f s\u00f6zle\u015fmesinin feshi ge\u00e7ersiz kabul edilmektedir.<\/p>\n<p style=\"text-align: justify;\"><strong><span style=\"color: #333399;\">S.5 \u00d6zel sekt\u00f6rde maa\u015f zamm\u0131 hangi aral\u0131klarla ve ne kadar olmal\u0131d\u0131r?<\/span><\/strong><\/p>\n<p style=\"text-align: justify;\">\u00d6zel i\u015fyerlerinde maa\u015f zamm\u0131 s\u00f6zle\u015fme veya Toplu S\u00f6zle\u015fmelerde belirtilen s\u00fcreler ve oranlarda olabilir. Bu konuda yasalarda zam ve oranlar\u0131 d\u00fczenleyen bir madde bulunmamaktad\u0131r. E\u011fer i\u015fveren yay\u0131nlad\u0131\u011f\u0131 i\u00e7 t\u00fcz\u00fck ve s\u00f6zle\u015fmelerde zam s\u00f6z\u00fc vermiyorsa yasalar zam yapmaya zorlayamayacakt\u0131r. B\u00f6yle bir yaz\u0131 bulunmas\u0131 halinde i\u015fveren bu zaman ve oranla ba\u011fl\u0131d\u0131r.<\/p>\n<p style=\"text-align: justify;\"><strong><span style=\"color: #333399;\">S.6 Normal \u00e7al\u0131\u015fma ve fazla \u00e7al\u0131\u015fma nedir?<\/span><\/strong><\/p>\n<p style=\"text-align: justify;\">Normal \u00e7al\u0131\u015fma 4857 say\u0131l\u0131 yasa ile tan\u0131mlanan haftal\u0131k 45 saat ve g\u00fcnl\u00fck 7,5 saatlik \u00e7al\u0131\u015fma s\u00fcresini g\u00f6stermektedir. Bu s\u00fcrenin \u00fczerinde mesai yapt\u0131r\u0131lmas\u0131 ise \u0130\u015f K. 41 maddeye g\u00f6re fazla \u00e7al\u0131\u015fma say\u0131lmakta ve ek \u00fccrete tabidir.<\/p>\n<p style=\"text-align: justify;\">Bu \u00fccret fazla \u00e7al\u0131\u015fman\u0131n her saati i\u00e7in 1,5 saatlik \u00fccret \u015feklinde \u00f6denir. Yani normal saat \u00fccretinden %50 zaml\u0131 bir \u00f6deme yap\u0131l\u0131r.<\/p>\n<p style=\"text-align: justify;\">Bu \u00f6deme dinlendirme \u015feklinde de olabilmektedir.<\/p>\n<p style=\"text-align: justify;\">K\u0131smi s\u00fcreli s\u00f6zle\u015fme ile \u00e7al\u0131\u015fanlara, sa\u011fl\u0131k nedeniyle s\u0131n\u0131rl\u0131 s\u00fcreli \u00e7al\u0131\u015fanlara ve gece vardiyas\u0131nda \u00e7al\u0131\u015fanlara fazla \u00e7al\u0131\u015fma yapt\u0131r\u0131lamaz. (\u0130\u015f K. 63, 69)<\/p>\n<p style=\"text-align: justify;\"><strong><span style=\"color: #333399;\">S.7 Emekli olduktan sonra \u00e7al\u0131\u015fanlar izin hakk\u0131n\u0131 nas\u0131l kullan\u0131r, k\u0131dem tazminat\u0131 hak ederler mi?<\/span><\/strong><\/p>\n<p style=\"text-align: justify;\">Emekli olduktan sonra ister SGDP \u00f6deyerek, isterse yeniden maa\u015f kesintisi uygulay\u0131p normal \u00e7al\u0131\u015fan olarak \u00e7al\u0131\u015f\u0131lmas\u0131 halinde de izin hak edi\u015fi devam eder. Bu \u00e7al\u0131\u015fmadan \u00f6nceki s\u00fcre ayn\u0131 i\u015fyerinde ge\u00e7mi\u015f ise birle\u015ftirilerek toplam k\u0131dem \u00fczerinden izin hakk\u0131 kulland\u0131r\u0131l\u0131r. Uygulamada da g\u00f6r\u00fclen bir durumdur. Bir i\u015fverende farkl\u0131 zamanlarda \u00e7al\u0131\u015fm\u0131\u015f olanlar i\u00e7inde durum b\u00f6yledir.<\/p>\n<p style=\"text-align: justify;\">Ancak k\u0131dem tazminat\u0131n\u0131 alarak hizmet akdi sona eren ki\u015finin yeniden ayn\u0131 i\u015fyeriyle anla\u015farak i\u015fine SGDP olarak devam etmesi halinde izin k\u0131deminin yeniden ba\u015flayaca\u011f\u0131 konusunda g\u00f6r\u00fc\u015flerde bulunmaktad\u0131r.<\/p>\n<p style=\"text-align: justify;\">K\u0131dem tazminat\u0131 emekli olduktan sonra \u00f6denece\u011fi i\u00e7in yeniden i\u015fe ba\u015flayan i\u015f\u00e7i i\u00e7in SGDP \u00f6denmesi veya maa\u015f\u0131n\u0131 kestirerek normal \u00e7al\u0131\u015fan gibi prim \u00f6demeye ba\u015flamas\u0131 halinde fark etmeksizin k\u0131dem tazminat\u0131 s\u00fcresi ba\u015flar. Bu s\u00fcre bir y\u0131l\u0131 doldurduktan sonra k\u0131dem tazminat\u0131 hak etmi\u015f olur. \u0130\u015f yerinin kapanmas\u0131 veya i\u015ften \u00e7\u0131kar\u0131lmas\u0131 durumunda k\u0131dem tazminat\u0131 \u00f6denir.<\/p>\n<p style=\"text-align: justify;\"><strong><span style=\"color: #333399;\">S.8 Halen \u00e7al\u0131\u015fmakta oldu\u011fu firmada daha \u00f6nce \u00e7al\u0131\u015fm\u0131\u015f ve k\u0131dem tazminat\u0131 almadan ara vermi\u015f bir i\u015f\u00e7i \u015fu anda emekli oldu\u011funda hangi s\u00fcreden k\u0131dem tazminat\u0131 al\u0131r?<\/span><\/strong><\/p>\n<p style=\"text-align: justify;\">4857 say\u0131l\u0131 i\u015f kanunu k\u0131dem tazminat\u0131 konusunu i\u00e7ermemektedir. Getirilen ge\u00e7ici 6. madde ile bu sorunu \u00e7\u00f6zmektedir. 1475 say\u0131l\u0131 yasan\u0131n 14. maddesine at\u0131fta bulunuldu\u011fundan o maddede \u015fu kural getirilmi\u015fti, \u201ci\u015f\u00e7ilerin k\u0131demleri, hizmet akdinin devam etmi\u015f veya fas\u0131lalarla yeniden akdedilmi\u015f olmas\u0131na bak\u0131lmaks\u0131z\u0131n, ayn\u0131 i\u015fverenin bir veya de\u011fi\u015fik i\u015fyerlerinde \u00e7al\u0131\u015ft\u0131klar\u0131 s\u00fcreler g\u00f6z \u00f6n\u00fcne al\u0131narak hesaplan\u0131r\u201d. Bu kurala g\u00f6re ayn\u0131 i\u015fverene ba\u011fl\u0131 t\u00fcm s\u00fcreler dikkate al\u0131narak hesaplan\u0131r.<\/p>\n<p style=\"text-align: justify;\"><strong><span style=\"color: #333399;\">S.9 Sigortal\u0131lara ne kadar s\u00fcre \u00e7al\u0131\u015ft\u0131ktan sonra sa\u011fl\u0131k yard\u0131m\u0131 devlet\u00e7e sa\u011flan\u0131r?<\/span><\/strong><\/p>\n<p style=\"text-align: justify;\">Sigortal\u0131lar i\u015f kazas\u0131 ve meslek hastal\u0131klar\u0131 durumunda s\u00fcreye bak\u0131lmaks\u0131z\u0131n devlet\u00e7e sa\u011fl\u0131k yard\u0131mlar\u0131ndan faydalan\u0131rlar. Di\u011fer sa\u011fl\u0131k sorunlar\u0131nda ise, hastaneye m\u00fcracaat\u0131ndan bir y\u0131l \u00f6nce en az 90 g\u00fcn sigorta pirimi yat\u0131rmak \u015fart\u0131yla sa\u011fl\u0131k yard\u0131mlar\u0131ndan faydalan\u0131r.<\/p>\n<p style=\"text-align: justify;\">Sigortal\u0131n\u0131n tedavi haricinde\u00a0ge\u00e7ici i\u015f g\u00f6remezlik \u00f6dene\u011fi\u00a0almas\u0131 i\u00e7in ise 120 g\u00fcn sigorta primi yat\u0131rm\u0131\u015f olmas\u0131 gerekmektedir.<\/p>\n<p style=\"text-align: justify;\"><strong><span style=\"color: #333399;\">s.10 Y\u0131ll\u0131k \u00dccretli \u0130zin hakk\u0131 ne zaman ba\u015flar ve ne zaman kullan\u0131lmal\u0131d\u0131r?<\/span><\/strong><\/p>\n<p style=\"text-align: justify;\">Y\u0131ll\u0131k \u00fccretli izin hakk\u0131 fiilen bir y\u0131l \u00e7al\u0131\u015fan i\u015f\u00e7iler i\u00e7in dinlenme s\u00fcresi olarak kulland\u0131r\u0131lmas\u0131 gereken izinlerdir. Bu izin s\u00fcresi k\u0131deme g\u00f6re esas al\u0131nm\u0131\u015ft\u0131r.<\/p>\n<ul style=\"text-align: justify;\">\n<li>1-5 y\u0131l aras\u0131 \u00e7al\u0131\u015fanlara 14 i\u015f g\u00fcn\u00fc<\/li>\n<li>5-15 y\u0131l aras\u0131 \u00e7al\u0131\u015fanlara 20 i\u015f g\u00fcn\u00fc<\/li>\n<li>15 y\u0131ldan fazla \u00e7al\u0131\u015fanlara 26 i\u015f g\u00fcn\u00fc y\u0131ll\u0131k \u00fccretli izin verilir.<\/li>\n<\/ul>\n<p style=\"text-align: justify;\">Bu s\u00fcrelerde izin kullan\u0131lmamas\u0131 halinde i\u015f akdinin feshinden sonra \u00e7\u0131plak son \u00fccret \u00fczerinde izin \u00fccretinin \u00f6denmesi zorunludur. Bu \u00fccrete giydirilmi\u015f \u00fccret olarak bilinen sosyal yard\u0131mlar, yemek paras\u0131 vs eklenmez. Bayram, hafta tatili ve resmi tatiller y\u0131ll\u0131k izne denk gelmi\u015f ise izin \u00fccretinin hesab\u0131nda dikkate al\u0131nmaz.<\/p>\n<p style=\"text-align: justify;\"><strong><span style=\"color: #333399;\">S.11 Do\u011fum yapan bayan i\u015f\u00e7i i\u015ften ayr\u0131larak k\u0131dem tazminat\u0131 alabilir mi?<\/span><\/strong><\/p>\n<p style=\"text-align: justify;\">Hay\u0131r, do\u011fum i\u015ften ayr\u0131lmak i\u00e7in hakl\u0131 neden olmad\u0131\u011f\u0131 gibi, k\u0131dem tazminat\u0131 al\u0131nmas\u0131 i\u00e7inde yasal bir gereklilik de\u011fildir. Do\u011fum yapan bayan i\u015f\u00e7i 8+8 olmak \u00fczere do\u011fumdan \u00f6nce ve sonra istirahat kullanma ve bu s\u00fcre i\u00e7in SGK dan ge\u00e7ici i\u015f g\u00f6remezlik \u00f6dene\u011fi alma hakk\u0131na sahiptir.<\/p>\n<p style=\"text-align: justify;\"><strong><span style=\"color: #333399;\">S.12 Fazla mesai \u00fccretleri k\u0131dem tazminat\u0131n\u0131n hesab\u0131nda dikkate al\u0131n\u0131r m\u0131?<\/span><\/strong><\/p>\n<p style=\"text-align: justify;\">Hay\u0131r, fazla mesai o aya ait \u015faz bir \u00f6deme olup her ay mutat \u00f6denen \u00fccret ve \u00fccret benzeri \u00f6demelerin br\u00fct hesab\u0131 \u00fczerinden k\u0131dem tazminat\u0131 hesaplan\u0131r. Buna yemek paras\u0131, ula\u015f\u0131m servis paras\u0131, y\u0131ll\u0131k ikramiyeler d\u00e2hil edilerek tazminata esas giydirilmi\u015f br\u00fct \u00fccret bulunur.<\/p>\n<p style=\"text-align: justify;\"><strong><span style=\"color: #333399;\">S.13 Kullan\u0131lmayan \u00f6nceki y\u0131llara ait y\u0131ll\u0131k \u00fccretli izin kar\u015f\u0131l\u0131\u011f\u0131 izin \u00fccreti halen \u00e7al\u0131\u015f\u0131rken al\u0131nabilir mi?<\/span><\/strong><\/p>\n<p style=\"text-align: justify;\">Hay\u0131r, i\u015ften ayr\u0131lmadan \u00f6nceye ait veya hak edilen y\u0131la ait olsun izin \u00fccrete \u00e7evrilemez ve \u00f6denemez. Bu haktan yararlan\u0131labilmesi i\u00e7in; i\u015f s\u00f6zle\u015fmesinin evlilik tarihinden itibaren 1 y\u0131l i\u00e7inde yaz\u0131l\u0131 olarak feshi, evlili\u011fi g\u00f6steren belgenin i\u015fverene sunulmas\u0131, feshin gerek\u00e7esinin evlilik oldu\u011funun a\u00e7\u0131k\u00e7a belirtilmesi gerekmektedir.<\/p>\n<p style=\"text-align: justify;\"><b>4- K\u0131dem tazminat\u0131 hakk\u0131 nas\u0131l hesaplan\u0131r?<br \/>\n<\/b><\/p>\n<p style=\"text-align: justify;\">Herhangi bir i\u015f s\u00f6zle\u015fmesinin k\u0131dem tazminat\u0131n\u0131 gerektiren bir nedenle feshi durumunda, \u00e7al\u0131\u015f\u0131lan her tam y\u0131l i\u00e7in 30 g\u00fcnl\u00fck br\u00fct \u00fccret tutar\u0131nda k\u0131dem tazminat\u0131 \u00f6denmektedir. Bir y\u0131ldan artan s\u00fcrelerde oranlanarak hesaplamaya dahil edilecektir. K\u0131dem tazminat\u0131 hesaplamalar\u0131 s\u0131ras\u0131nda i\u015f\u00e7iye \u00f6denen \u00fccretin yan\u0131s\u0131ra, kendisine d\u00fczenli olarak sa\u011flanan t\u00fcm para ve para ile \u00f6l\u00e7\u00fclebilen menfaatlerin (yol paras\u0131, yemek paras\u0131, d\u00fczenli olmak ko\u015fulu, ikramiye \u00f6demeleri v.b.) br\u00fct tutarlar\u0131 dikkate al\u0131nmaktad\u0131r. Her tam \u00e7al\u0131\u015fma y\u0131l\u0131 i\u00e7in \u00f6denen k\u0131dem tazminat\u0131 tutar\u0131, fesih tarihinde ge\u00e7erli olan k\u0131dem tazminat\u0131 tavan\u0131 ile s\u0131n\u0131rland\u0131r\u0131lm\u0131\u015ft\u0131r.<\/p>\n<div id=\"NewsContent\">\n<p style=\"text-align: justify;\"><b>5- \u0130\u015fyerinin sat\u0131lmas\u0131 durumunda i\u015f\u00e7i k\u0131dem tazminat\u0131n\u0131n \u00f6denmesini isteyebilir mi?<br \/>\n<\/b><\/p>\n<p style=\"text-align: justify;\">Herhangi bir i\u015fyerinin k\u0131smen veya t\u00fcm\u00fcyle devredilmesi durumunda, s\u00f6z konusu i\u015fyerinde \u00e7al\u0131\u015fmakta olanlar ayn\u0131 \u015fartlarla \u00e7al\u0131\u015fmaya devam edeceklerdir. \u0130\u015fyerinin devri, \u00e7al\u0131\u015fanlar\u0131n yasal haklar\u0131 konusunda herhangi bir kayba yol a\u00e7mayacak, \u00e7al\u0131\u015fanlara i\u015fyerinin devri nedeni ile k\u0131dem tazminat\u0131 \u00f6denmesi gerekmeyecektir. Gerek k\u0131dem tazminat\u0131, gerekse y\u0131ll\u0131k \u00fccretli izin haklar\u0131n\u0131n belirlenmesi gerekti\u011finde devir \u00f6ncesi ve devir sonras\u0131 olu\u015fan toplam \u00e7al\u0131\u015fma s\u00fcresi esas al\u0131nacakt\u0131r.<\/p>\n<p style=\"text-align: justify;\"><b>6- \u0130\u015fyerinin ta\u015f\u0131nmas\u0131 veya \u00e7al\u0131\u015fma \u015fartlar\u0131n\u0131n de\u011fi\u015ftirilmesi halinde i\u015f\u00e7i k\u0131dem tazminat\u0131n\u0131 alarak i\u015ften ayr\u0131labilir mi?<br \/>\n<\/b><\/p>\n<p style=\"text-align: justify;\">\u0130\u015fveren i\u015f\u00e7i ili\u015fkileri, yasa ile belirlenen esaslar \u00e7er\u00e7evesinde i\u015f s\u00f6zle\u015fmelerinde d\u00fczenlenmektedir. Bu kapsamda; i\u015fin niteli\u011fi, g\u00f6rev tan\u0131mlar\u0131, \u00e7al\u0131\u015fma s\u00fcre ve ko\u015fullar\u0131, i\u015f\u00e7iye \u00f6denecek \u00fccret ve di\u011fer esaslar i\u015f s\u00f6zle\u015fmelerinde d\u00fczenlenmektedir. \u0130\u015f s\u00f6zle\u015fmesi h\u00fck\u00fcmleri, i\u015fyeri uygulamalar\u0131 veya \u00e7al\u0131\u015fma ko\u015fullar\u0131 konusunda de\u011fi\u015fiklik yapmak isteyen i\u015fveren, durumu yaz\u0131l\u0131 olarak bildirmek ve i\u015f\u00e7inin onay\u0131n\u0131 almakla y\u00fck\u00fcml\u00fcd\u00fcr. \u0130\u015f\u00e7i taraf\u0131ndan 6 g\u00fcn i\u00e7inde kabul edilmeyen de\u011fi\u015fiklikler i\u015f\u00e7iyi ba\u011flamamaktad\u0131r. \u0130\u015f s\u00f6zle\u015fmesinin bu nedenle feshi halinde, k\u0131dem tazminat\u0131 ve bildirim s\u00fcreleri konusundaki y\u00fck\u00fcml\u00fcl\u00fcklere ba\u011fl\u0131 kal\u0131nacakt\u0131r<\/p>\n<p style=\"text-align: justify;\"><b>7- \u00dccreti art\u0131r\u0131lmayan i\u015f\u00e7i k\u0131dem tazminat\u0131n\u0131 alarak i\u015ften ayr\u0131labilir mi?<br \/>\n<\/b><\/p>\n<p style=\"text-align: justify;\">\u00dccretlerin hangi d\u00f6nemlerde veya oranlarda art\u0131r\u0131laca\u011f\u0131na ili\u015fkin herhangi bir \u00e7er\u00e7eve belirlenmi\u015f durumda de\u011fildir. \u00dccret uygulamalar\u0131 konusundaki yasal d\u00fczenleme asgari \u00fccretin alt\u0131nda \u00fccretle i\u015f\u00e7i \u00e7al\u0131\u015ft\u0131r\u0131lamayaca\u011f\u0131 ile s\u0131n\u0131rl\u0131d\u0131r. Bunun \u00f6tesinde \u00fccret uygulamalar\u0131na ili\u015fkin esaslar, i\u015f s\u00f6zle\u015fmelerinde belirlenebilmektedir. \u0130\u015f s\u00f6zle\u015fmesinde ba\u011flay\u0131c\u0131 bir h\u00fck\u00fcm bulunmamas\u0131 halinde, uygulamaya ili\u015fkin inisiyatif i\u015fverene aittir. \u0130\u015f s\u00f6zle\u015fmesinde herhangi bir h\u00fck\u00fcm bulunmamas\u0131na kar\u015f\u0131n, \u00fccret art\u0131\u015flar\u0131ndaki anla\u015fmazl\u0131k nedeni ile i\u015ften ayr\u0131lan i\u015f\u00e7i istifa etmi\u015f say\u0131laca\u011f\u0131ndan, herhangi bir tazminat hakk\u0131 olu\u015fmayacakt\u0131r<\/p>\n<p style=\"text-align: justify;\"><b>8- Hamilelik veya do\u011fum nedeni ile i\u015ften ayr\u0131lan i\u015f\u00e7i, k\u0131dem tazminat\u0131na hak kazan\u0131r m\u0131?<br \/>\n<\/b><\/p>\n<p style=\"text-align: justify;\">\u0130\u015ften kendi iste\u011fiyle (istifa) ayr\u0131lan i\u015f\u00e7inin, herhangi bir tazminat hakk\u0131 olu\u015fmamaktad\u0131r. s\u00f6zle\u015fmesini kendi iste\u011fiyle fesih eden i\u015f\u00e7inin (istifa), herhangi bir tazminat hakk\u0131 olu\u015fmamaktad\u0131r. \u00c7al\u0131\u015fma s\u00fcresinin belirli bir s\u00fcreyi a\u015fmas\u0131, bu konudaki genel uygulamay\u0131 de\u011fi\u015ftirmemektedir. \u00d6te yandan; i\u015f s\u00f6zle\u015fmesini fesih etmek isteyen i\u015f\u00e7i (istifa), feshi yaz\u0131l\u0131 olarak ve \u00e7al\u0131\u015fma s\u00fcresine g\u00f6re 2 ile 8 hafta aras\u0131nda de\u011fi\u015fen s\u00fcrelerle uygulanan bildirim s\u00fcresine ba\u011fl\u0131 kalarak i\u015fverenine iletmekle y\u00fck\u00fcml\u00fcd\u00fcr.<\/p>\n<p style=\"text-align: justify;\"><b>10- \u0130\u015fyerinde 1,5 y\u0131ldan beri \u00e7\u0131rak olarak \u00e7al\u0131\u015f\u0131yorum. \u0130\u015fveren beni istemiyor, k\u0131dem tazminat\u0131 alabilir miyim?<br \/>\n<\/b><\/p>\n<p style=\"text-align: justify;\">Alamazs\u0131n\u0131z. \u0130\u015f
